DECISION OF THE EEA JOINT COMMITTEE No 147/2025
of 13 June 2025
amending Annex XIII (Transport) to the EEA Agreement [2025/1839]
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,
Whereas:

(1) |
Commission Delegated Regulation (EU) 2023/1768 of 14 July 2023 laying down detailed rules for the certification and declaration of air traffic management/air navigation services systems and air traffic management/air navigation services constituents (1) is to be incorporated into the EEA Agreement. |
|
(2) |
Commission Implementing Regulation (EU) 2023/1769 of 12 September 2023 laying down technical requirements and administrative procedures for the approval of organisations involved in the design or production of air traffic management/air navigation services systems and constituents and amending Implementing Regulation (EU) 2023/203 (2) is to be incorporated into the EEA Agreement. |

(3) |
Commission Implementing Regulation (EU) 2023/1772 of 12 September 2023 amending Implementing Regulation (EU) No 923/2012 as regards the operating rules related to the use of Air Traffic Management and Air Navigation Services systems and constituents in the Single European Sky airspace and repealing Regulation (EC) No 1033/2006 (3) is to be incorporated into the EEA Agreement. |

Implementing Regulation (EU) 2023/1772 repeals Commission Regulation (EC) No 1033/2006 (4), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement. |

(5) |
Annex XIII to the EEA Agreement should therefore be amended accordingly, |
HAS ADOPTED THIS DECISION:
Article 1
Annex XIII to the EEA Agreement is amended as follows:

the following indent is added in point 66wk (Commission Implementing Regulation (EU) No 923/2012):
|

(2) |
the following is added in point 66zbh (Commission Implementing Regulation (EU) 2023/203): ‘, as amended by:
|
|
(3) |
the following points are inserted after point 66zbh (Commission Implementing Regulation (EU) 2023/203):
|
|
(4) |
the text of point 66wc (Commission Regulation (EC) No 1033/2006) is deleted. |
Article 2
The texts of Delegated Regulation (EU) 2023/1768 and Implementing Regulations (EU) 2023/1769 and (EU) 2023/1772 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.
Article 3
This Decision shall enter into force on 14 June 2025, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1), or on the day of the entry into force of Decision of the EEA Joint Committee No 146/2025 of 13 June 2025 (5), whichever is the later.
Article 4
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
