Re:

By their action under Article 263 TFEU, the applicants seek the annulment of Commission Decision (EU) 2019/1352 of 2 April 2019 on the State aid SA.44896 implemented by the United Kingdom concerning CFC Group Financing Exemption (OJ 2019 L 216, p. 1).

Operative part of the order

1.

There is no longer any need to adjudicate on the present action.

2.

There is no longer any need to adjudicate on the application to intervene submitted by the United Kingdom of Great Britain and Northern Ireland.

3.

The European Commission shall bear its own costs and pay those incurred by Hill & Smith Holdings plc and Hill & Smith Overseas Ltd, with the exception of those relating to the application to intervene.

4.

Hill & Smith Holdings, Hill & Smith Overseas, the Commission and the United Kingdom shall bear their own costs relating to the application to intervene.
