COMMISSION IMPLEMENTING REGULATION (EU) 2026/387

of 23 February 2026

establishing the format of the European technical assessment pursuant to Regulation (EU) 2024/3110 of the European Parliament and of the Council

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) 2024/3110 of the European Parliament and of the Council of 27 November 2024 laying down harmonised rules for the marketing of construction products and repealing Regulation (EU) No 305/2011 (1), and in particular Article 37(4) thereof,

Whereas:

Article 37(3) of Regulation (EU) 2024/3110 establishes requirements for the content of the European technical assessment (‘ETA’). Since the technical details necessary for the implementation of the assessment and verification systems that are to be applied are set out in the applicable European assessment document (‘EAD’), the ETA should contain only the necessary additional technical details for the implementation of the assessment and verification systems which are not included in the EAD.

ETA format should be adapted to present the relevant information in accordance with the elements provided in the applicable EAD. It should also be consistent with the guidelines to ensure interoperability of the human and machine-readable formats for the declaration of performance and conformity developed in accordance with Article 35(2) point (c) of Regulation (EU) 2024/3110. Those technical details should be set out in a general and a specific part of the ETA, with the general part covering identification and administrative information and the specific part covering technical information, in order to ensure a clear, structured and harmonised presentation of that information.

In order to protect confidential technical information on the product, the manufacturer should be able to indicate to the responsible technical assessment body which parts of the product description are confidential and are not be disclosed together with the ETA. Confidential information should be included in separate Annexes to the ETA.

The organisation for technical assessments established in accordance with Article 41(1) of Regulation (EU) 2024/3110 and the Construction Products Regulation (‘CPR’) Acquis Expert Group established by Article 4(1) of that Regulation have been consulted.

(5)

The measures provided for in this Regulation are in accordance with the opinion of the Committee on Construction Products established by Article 90 of Regulation (EU) 2024/3110,

HAS ADOPTED THIS REGULATION:

Article 1

The format of the European technical assessment is set out in the Annex.

Article 2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

ANNEX

Format of the European technical assessment

Where the ETA is printable, the fields must be provided in a way that allows clear identification. In human- and machine-readable ETAs the information must be provided in a formally structured way which is publicly available.

Fields to be included in the ETA:

1.

List of fields to be included in printable ETA only

(a)

logo of the technical assessment body issuing the ETA;

(b)

logo of the European organisation for technical assessment;

(c)

signature (at the end of the document excluding annexes).

2.

List of fields included in machine-readable ETA only

(a)

identification code of the structured format used (schema) with version;

(b)

permalink to the information describing the structured format used (data template and data dictionary);

(c)

digital signature.

3.

List of fields to be included in the general part of the ETA (printable and human- and machine-readable formats)

(a)

reference to Regulation (EU) 2024/3110;

(b)

ETA code;

(c)

version number of the ETA;

(d)

ETA version superseded, if any;

(e)

date of issue of the ETA;

(f)

language of the ETA;

(g)

identification number of the technical assessment body issuing the ETA;

(h)

name of the technical assessment body issuing the ETA;

(i)

address of the technical assessment body issuing the ETA;

(j)

trade name of the product covered by the ETA;

(k)

full code of the EAD used for issuing the ETA;

(l)

title of the EAD used for issuing the ETA in English;

(m)

manufacturer;

(n)

address of the manufacturer;

(o)

manufacturing plants covered by the ETA (field to be repeated where ETA covers more than one address of the manufacturing plant):

(1)

address;

(2)

code, if address is to be treated as confidential information;

(p)

number of pages of the ETA;

(q)

number of non-confidential annexes to the ETA, if any;

(r)

number of confidential annexes to the ETA, if any;

(s)

reference to the annex containing confidential information and not included in the ETA when publicly disseminated, if any (field to be repeated where more than one annex is provided).

List of fields to be included in the specific part of the Eta (printable and human- and machine-readable formats)

(a)

technical description of the product or of the range of products covered by the ETA;

(b)

further specification of the intended uses in accordance with the applicable EAD;

(c)

performance assessment results of the product, including the assessment of the performance for the predetermined environmental essential characteristics in accordance with Article 15(3) of Regulation (EU) 2024/3110 and the necessary information to ensure digitalisation guidelines provided in the EAD including the following information for each essential characteristic:

(1)

name of the essential characteristic;

(2)

unambiguous reference to the applicable assessment method;

(3)

the physical quantity of the performance expressed according to the SI metric system: time (T), length (L), mass (M), electric current (I), thermodynamic temperature (K), amount of substance (N) and luminous intensity (J), a derivation of SI base units or a ratio;

(4)

expression of results as a level, class or description;

(5)

units in which the performance is provided or dimensionless;

(6)

additional information necessary to interpret the information provided;

(d)

assessment and verification system to be applied (field to be repeated in case of more than one assessment and verification system are applicable);

(e)

the technical details not included in the EAD necessary for the implementation of the assessment and verification system, if any;

(f)

reference to the legal base setting out the applicable assessment and verification system (field to be repeated in case of more than one legal base are applicable);

(g)

the technical details necessary for the implementation of the assessment and verification system.

5.

List of fields to be included in relation to the responsible person in the technical assessment body for issuing the ETA

(a)

name of the responsible person;

(b)

position of the responsible person.
