specifying the technical formats for reporting by the Member States pursuant to Regulation (EU) No 1143/2014 of the European Parliament and of the Council, and repealing Commission Implementing Regulation (EU) 2017/1454

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1143/2014 of the European Parliament and of the Council of 22 October 2014 on the prevention and management of the introduction and spread of invasive alien species (1), and in particular of Article 24(4) thereof,

Whereas:

The Commission adopted Implementing Regulation (EU) 2017/1454 (2) specifying the technical formats for reporting by the Member States pursuant to Regulation (EU) No 1143/2014.

However, the technical formats used, in accordance with Implementing Regulation (EU) 2017/1454, in the first round of reporting by Member States proved insufficient to ensure that reports are of good quality, leading to ambiguity and underreporting.

It is therefore necessary to address such insufficiency by facilitating the collection of data for the purpose of deriving key indicators, and by favouring the reference to information that is already publicly available at national level while using the benefits of applying Directive 2007/2/EC of the European Parliament and of the Council (3) for spatial data and ensuring coherence with related policies, such as Directives 2000/60/EC (4), 2008/56/EC (5) and 2009/147/EC (6) of the European Parliament and of the Council and Council Directive 92/43/EEC (7).

Furthermore, Directive 2007/2/EC requires that public authorities in the Member States make spatial data sets available in accordance with the implementing rules on metadata, network services and interoperability of spatial data sets and services set out in Commission Regulation (EU) No 1089/2010 (8), including the data specified in section 18 (‘Species Distribution’) of Annex IV to that Regulation.

Given that the most substantial part of this Implementing Regulation, the technical formats for reporting in Annex are comprehensively modified, Implementing Regulation (EU) 2017/1454 should be repealed and replaced.

The measures provided for in this Regulation are in accordance with the opinion of the Committee on Invasive Alien Species,

HAS ADOPTED THIS REGULATION:

Article 1

The technical formats for reporting by the Member States pursuant to Article 24(1) of Regulation (EU) No 1143/2014 are set out in the Annex to this Regulation.

Article 2

Implementing Regulation (EU) 2017/1454 is repealed.

Article 3

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Member States shall submit information in relation to all questions, except for those indicated as optional.

SECTION A

All questions under Section A shall be completed for each of the invasive alien species included on the Union list referred to in Article 4(1) of Regulation (EU) No 1143/2014, in the version in force by the end of the last calendar year covered by the report.

For each of the species of regional concern for which, by the same date, an implementing act adopted in accordance with Article 11(2) of Regulation (EU) No 1143/2014 has entered into force, only questions 1 to 5 and 14 to 22 shall be completed.

Question 1

Provide the scientific name of the species.

Question 2

Optional: Provide the common name of the species in the national language.

Question 3

Indicate whether the species is considered as present in the territory of the Member State (excluding the outermost regions where applicable).

Several boxes may be ticked.

For the option ‘Yes, present in contained holding’, tick this option if the information is readily available, i.e. no need to conduct ad hoc research or surveys.

Questions 4.a. to 4.d.

If the answer to question 3 is ‘Yes, currently present in the environment’, provide a file with data on the distribution of the species applying Directive 2007/2/EC. This file shall use the spatial object types defined in Section 18 of Annex IV (‘Species Distribution’) to Regulation (EU) No 1089/2010. Information on the reproductive status, reproduction, introduction and spread patterns shall be specified using appropriate code lists.
