COMMISSION IMPLEMENTING DECISION (EU) 2025/424

of 4 March 2025

amending Implementing Decision (EU) 2023/2584 as regards an update of the referenced standards and the addition of new referenced standards

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) 1025/2012 of the European Parliament and of the Council of 25 October 2012 on European standardisation, amending Council Directives 89/686/EEC and 93/15/EEC and Directives 94/9/EC, 94/25/EC, 95/16/EC, 97/23/EC, 98/34/EC, 2004/22/EC, 2007/23/EC, 2009/23/EC and 2009/105/EC of the European Parliament and of the Council and repealing Council Decision 87/95/EEC and Decision No 1673/2006/EC of the European Parliament and of the Council (1), and in particular Article 10(6) thereof,

Whereas:

In accordance with Article 17 of Directive (EU) 2016/797 of the European Parliament and of the Council (2), interoperability constituents and subsystems which are in conformity with harmonised standards or parts thereof, the references of which have been published in the Official Journal of the European Union, are to be presumed to be in conformity with the essential requirements covered by those standards or parts thereof set out in that Directive.

By Commission Implementing Decision C(2023) 1057 (3) the Commission made a request to the European Committee for Standardisation (CEN) and the European Committee for Electrotechnical Standardisation (Cenelec) for the drafting and the revision of harmonised standards in support of Directive (EU) 2016/797.

The Commission, together with CEN and Cenelec, has assessed whether the standards drafted or revised by CEN and Cenelec comply with the request set out in Implementing Decision C(2023) 1057.

The harmonised standards drafted, revised and amended by CEN and Cenelec based on Implementing Decision C(2023) 1057 satisfy all the requirements which they aim to cover, except for standards EN 15313:2024 and EN 16207:2024. It is therefore appropriate to publish the references of those standard in the Official Journal of the European Union.

Standard EN 50716:2023 should confer, within the limits of its scope, presumption of conformity with certain requirements of Commission Regulation (EU) 2016/919 (4) insofar Article 14 of Commission Implementing Regulation (EU) 2023/1695 (5) applies. It is therefore appropriate to publish the references of that standard in the Official Journal of the European Union.

With respect to standard EN 16207:2024, the Commission has concluded that regarding Regulation (EU) No 1302/2014, the standard should only give presumption of conformity for the points 4.2.4.8.2 (2) and (4) of the Annex to that Regulation per Annex ZA of the standard, and to point 4.2.4.8.2 (1) by applying the clause 8.1 of the standard. It is therefore appropriate to publish the references of that standard, with restrictions, in the Official Journal of the European Union.

As regards standard EN 15313:2024, the Commission has concluded that regarding points 4.2.3.5.2.1 and 4.2.3.5.2.2 of the Annex to Regulation (EU) No 1302/2014 and points 4.2.3.6.2 to 4.2.3.6.5 of the Annex to Regulation (EU) No 321/2013, the tolerances given by the standard should not be accumulated with the values given in the previously mentioned points, the values in those points should be considered as limit values. It is therefore appropriate to publish the references of that standard, with restrictions, in the Official Journal of the European Union.

Commission Implementing Decision (EU) 2023/2584 (6) should therefore be amended accordingly.

Compliance with a harmonised standard confers a presumption of conformity with the corresponding essential requirements set out in Union harmonisation legislation from the date of publication of the reference of such standard in the Official Journal of the European Union. This Decision should therefore enter into force on the date of its publication. However, to give all impacted stakeholders sufficient time to prepare for the application of the revised standards, the withdrawal of references of harmonised standards EN 14587-2:2009, EN 15313:2016, EN 15355:2019, EN 15624:2021, EN 16116-2:2021, EN 16286-1:2013, EN 45545-3:2013 and EN 45545-4:2013 should be deferred by 18 months from the date of entry into force of this Decision,

HAS ADOPTED THIS DECISION:

Article 1

Annex I to Implementing Decision (EU) 2023/2584 is amended in accordance with the Annex to this Decision.

Article 2

This Decision shall enter into force on the day of its publication in the Official Journal of the European Union.

Points (1), (4), (6), (8), (10), (13), (15) and (17) of the Annex shall apply from 6 September 2026.
