concerning emergency measures in relation to outbreaks of Newcastle disease in Poland

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 259(1), point (b), thereof,
Whereas:

(1) |
Newcastle disease (ND) is an infectious viral disease in birds and can have a severe impact on the profitability of poultry farming, causing disturbance to trade within the Union and exports to third countries. |
|
(2) |
In the event of an outbreak of ND, there is a risk that the disease agent may spread to other establishments where poultry or captive birds are kept. |
|
(3) |
Regulation (EU) 2016/429 establishes the legislative framework for the prevention and control of diseases that are transmissible to animals or humans. ND falls within the definition of a listed disease in that Regulation, and it is subject to the disease prevention and control rules laid down therein. In addition, Commission Delegated Regulation (EU) 2020/687 (2) supplements Regulation (EU) 2016/429 as regards the rules for the control of the listed diseases referred to in Article 9(1), points (a), (b) and (c) thereof, and defined as category A, B and C diseases in Commission Implementing Regulation (EU) 2018/1882 (3). In particular, Articles 21 and 22 of Delegated Regulation (EU) 2020/687 provide that in the event of an outbreak of a category A disease, including ND, in an establishment, the competent authority is to immediately establish a restricted zone, and for certain measures to be applied therein. Article 21(1) of that Delegated Regulation provides that the restricted zone is to comprise a protection zone, a surveillance zone, and, if necessary, further restricted zones around or adjacent to the protection and surveillance zones. |

Poland has informed the Commission of the epidemiological situation as regards ND on its territory. From September 2024 and throughout that year, ND outbreaks were detected in that Member State in establishments where poultry or captive birds were kept, mainly in Podalskie and Mazowieckie voivodships. Those outbreaks affected establishments and poultry categories, such as broilers, where vaccination against ND was not routinely implemented. Following those outbreaks, the competent authority of Poland took the necessary disease control measures required in accordance with Delegated Regulation (EU) 2020/687. |

From February 2025, the disease started to spread and new outbreaks of ND have been detected, in Kujawsko-Pomorskie, Lodskie, Lubelskie, Malopolskie, Mazowieckie, Podkarpackie, Pomorskie, Swietokrzyskie, Warminsko-Mazurkie and Wielkopolskie voivodships, continuing to affect non-vaccinated establishments where poultry or captive birds were kept. Based on the development of the epidemiological situation, the competent authority of Poland decided to take certain additional measures besides those already applied by Poland, in particular regarding the obligation of poultry establishments to implement vaccination against ND. After the entry into force of that new obligation, the number of outbreaks decreased, and no new outbreaks have been confirmed during August and September 2025. |

However, the epidemiological situation as regards ND in Poland started to deteriorate again in October 2025 and Poland notified the Commission of 13 new outbreaks of ND in that Member State in establishments where poultry or captive birds were kept. These new outbreaks are affecting establishments where poultry or captive birds were kept, situated in Kujawsko-Pomorskie, Lubuskie, Mazowieckie, Podlaskie, Warmińsko-Mazurskie, Wielkopolskie and Zachodniopomorskie voivodships, in areas where ND was not present before. |

Following those outbreaks, the competent authority of Poland has taken the necessary disease control measures required in accordance with Delegated Regulation (EU) 2020/687, including the establishment of protection and surveillance zones around the outbreaks. |

The Commission has examined the disease control measures taken by Poland and considers them to be insufficient. In particular, when outbreaks of ND are confirmed in an area with high density of poultry establishments, there is an increased risk of spread of the disease to other establishments where poultry or captive birds are kept in that area. |

(9) |
Consequently, following several outbreaks in an area of the Mazowieckie voivodeship with high density of poultry establishments and at increased risk for the spread of ND, a further restricted zone should be established around or adjacent to the protection and surveillance zones that were established in that area, in accordance with Article 21(1) of Delegated Regulation (EU) 2020/687. |

Therefore, in the current epidemiological situation with ND in Poland, where the disease has spread to different regions of that Member State, it is necessary to adopt emergency measures in order to immediately limit the spread of the disease and to mitigate the risk of further spread of the disease within the territory of Poland and to other Member States. |

The size of the protection, surveillance and further restricted zones, and duration of the measures to apply therein have been based on the requirements laid down in Articles 64(1) and 68(1) of Regulation (EU) 2016/429 and on the rules laid down in Delegated Regulation (EU) 2020/687, including the epidemiological situation as regards ND in the areas affected by that disease and the overall epidemiological situation in Poland as regards ND, as well as the level of risk for its further spread. |

(12) |
In addition, in order to prevent any unnecessary disturbance to trade within the Union and to avoid any unjustified disruptions to trade being imposed by third countries, it is necessary to rapidly lay down at Union level, in collaboration with Poland, the protection, surveillance zones and further restricted zone established by that Member State in accordance with Delegated Regulation (EU) 2020/687. |

Therefore, the areas concerned should now be listed as protection and surveillance zones, as well as the further restricted zone for Poland in the Annex to this Implementing Decision, to take account of the boundaries of the protection and surveillance zones, as well as the further restricted zone, established by that Member State following the new ND outbreaks in that Member State, as well as the required duration of the measures required to be applied in those zones, in accordance with Delegated Regulation (EU) 2020/687. |

(14) |
Given the urgency of the epidemiological situation in Poland as regards the spread of ND, and the need to prevent the disease spreading from the affected establishments in Poland to other parts of that Member State or to other Member States or third countries, it is appropriate that the measures laid down in this Decision apply as soon as possible. |
|
(15) |
The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS DECISION:
Article 1
Subject matter and scope
This Decision establishes at Union level:
|
(a) |
the protection and surveillance zones to be established by Poland following an outbreak or outbreaks of Newcastle disease in poultry or captive birds, in accordance with Article 21 of Delegated Regulation (EU) 2020/687, and the duration of the disease control measures to be applied in the protection zones in accordance with Article 39, and in the surveillance zones in accordance with Article 55 of that Delegated Regulation; |
|
(b) |
the further restricted zones to be established by Poland following an outbreak or outbreaks of Newcastle disease in poultry or captive birds, in accordance with Article 21 of Delegated Regulation (EU) 2020/687, and the duration of the measures to be applied in the further restricted zones. |
Article 2
The protection zone
Poland shall ensure that:

(a) |
the protection zones established by the competent authority of that Member State, in accordance with Article 21(1), point (a), of Delegated Regulation (EU) 2020/687, comprise at least the areas listed as protection zones in the Annex to this Decision; |
|
(b) |
the measures to be applied in the protection zones, as provided for in Article 39 of Delegated Regulation (EU) 2020/687, are maintained until at least the dates for the protection zones set out in the Annex to this Decision. |
Article 3
The surveillance zone
|
|
Poland shall ensure that: |
|
(a) |
the surveillance zones established by the competent authority of that Member State in accordance with Article 21(1), point (b), of Delegated Regulation (EU) 2020/687, comprise at least the areas listed as surveillance zones in the Annex to this Decision; |
|
(b) |
the measures to be applied in the surveillance zones, as provided for in Article 55 of Delegated Regulation (EU) 2020/687, are maintained until at least the dates for the surveillance zones set out in the Annex to this Decision. |
Article 4
The further restricted zone
Poland shall ensure that:

(a) |
the further restricted zones established by the competent authority of that Member State, in accordance with Article 21(1), point (c), of Delegated Regulation (EU) 2020/687, comprises at least the area listed as further restricted zone in the Annex to this Decision; |
|
(b) |
the measures to be applied in the further restricted zones as provided for in Article 21(1), point (c), of Delegated Regulation (EU) 2020/687, are maintained until at least the dates for the further restricted zones set out in the Annex to this Decision. |

This Decision is addressed to the Republic of Poland.
