on the position to be taken on behalf of the European Union within the Regional Steering Committee of the Transport Community as regards the amendment of the Annex to the Financial Rules and Auditing Procedures applicable to the Transport Community, adopted pursuant to Decision No 2022/02 of the Regional Steering Committee of the Transport Community

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 91 and Article 100(2), in conjunction with Article 218(9), thereof,

Having regard to the proposal from the European Commission,

Whereas:

(1)

The Treaty establishing the Transport Community (1) (the ‘TCT’) was approved on behalf of the Union by means of Council Decision (EU) 2019/392 (2). It entered into force on 1 May 2019.

(2)

The Regional Steering Committee of the Transport Community established by the TCT (the ‘Steering Committee’) was set up in order to ensure the administration and the proper implementation of the TCT.

(3)

Pursuant to Article 30 of the TCT, the Steering Committee is competent to lay down rules of the Permanent Secretariat of the Transport Community (the ‘Permanent Secretariat’). Under Article 35 of the TCT, the Steering Committee is empowered to adopt the budget of the Transport Community and the related financial governing rules.

The Steering Committee, during its meeting to be held on 4 December 2025, is to adopt a decision amending the rules that apply to the Permanent Secretariat when procuring goods, works or services on its own account, as laid down in the Annex to the Financial Rules and Auditing Procedures applicable to the Transport Community, adopted pursuant to Decision No 2022/02 of the Regional Steering Committee of the Transport Community of 15 December 2022 on the revised procedure for the implementation of the budget and the presenting and auditing of accounts, applicable to the Transport Community (‘Decision No 2022/02 of the Steering Committee’).

It is appropriate to establish the position to be taken on the Union’s behalf within the Steering Committee as the decision of that Committee will have legal effects.

(6)

The Union should support the adoption of the draft Decision attached to this Decision, as it will simplify the current rules governing the procurement by the Permanent Secretariat of certain simple and low-value goods and services, which is necessary for the continued proper functioning of the Permanent Secretariat.

(7)

The position of the Union within the Steering Committee should therefore be based on the attached draft Decision,

HAS ADOPTED THIS DECISION:

Article 1

The position to be taken on behalf of the European Union within the Regional Steering Committee of the Transport Community established by the Treaty establishing the Transport Community (the ‘Steering Committee’) regarding the amendment of the Annex to the Financial Rules and Auditing Procedures applicable to the Transport Community, adopted pursuant to Decision No 2022/02 of the Steering Committee, shall be based on the draft Decision of the Steering Committee attached to this Decision.

Article 2

Minor technical changes to the position set out in Article 1 may be agreed upon by the representatives of the Union in the Steering Committee without a further decision of the Council.

Article 3

This Decision shall enter into force on the date of its adoption.

amending the Annex to the Financial Rules and Auditing Procedures applicable to the Transport Community, adopted pursuant to Decision No. 2022/02 of the Regional Steering Committee of the Transport Community

THE REGIONAL STEERING COMMITTEE OF THE TRANSPORT COMMUNITY,

Having regard to the Treaty establishing the Transport Community (1), and in particular Article 24(1) and Article 35 thereof,

Having regard to Decision No. 2022/02 of the Regional Steering Committee of the Transport Community of 15 December 2022 on the revised procedure for the implementation of the budget and the presenting and auditing of accounts, applicable to the Transport Community,

Whereas:

(1)

The existing Annex to the Financial Rules and Auditing Procedures applicable to the Transport Community, adopted pursuant to Decision No. 2022/02 of the Regional Steering Committee of the Transport Community does not explicitly address instances where relevant provisions on the procurement of goods, works or services are absent or non-specific.

(2)

The procurement procedures for certain simple and low-value goods and services require a simpler and more efficient framework to ensure effective implementation.

(3)

It is imperative to enhance the procurement framework to allow for smoother execution of procurement procedures under the Treaty establishing the Transport Community while ensuring competitiveness, transparency and equal treatment in the procurement process,

HAS ADOPTED THIS DECISION:

Article 1

The Annex to the Financial Rules and Auditing Procedures applicable to the Transport Community, adopted pursuant to Decision No. 2022/02 of the Regional Steering Committee of the Transport Community, is amended as follows:

(1)

in Section 3, the following point is added:

‘4.2.

Simplified procurement procedure for low-value goods and services

For the procurement of simple, straightforward and routine services and supplies, including but not limited to venue hire, restaurant services, translation, equipment rental and purchase of items, where the precise volume and timing of delivery can be defined at the outset and where the estimated total value does not exceed EUR 20 000 (excluding VAT), a simplified procurement procedure shall apply.

This procedure shall consist of:

(a)

collecting at least three offers from eligible providers;

(b)

evaluating the offers on the basis of key factors such as price and ability to deliver the services or supplies;

(c)

awarding the contract and finalising it through a purchase order or a simplified direct contract.

This simplified procedure shall ensure adequate market consultation, while reducing administrative burdens. A record of the offers collected and the evaluation process shall be kept in order to allow for a proper audit trail and to ensure the transparency of the process.’

(2)

the following section is added:

‘5.   Section 4

5.1.

 In cases where this Annex does not contain explicit provisions, the rules and principles laid down in Directive 2014/24/EU of the European Parliament and of the Council of 26 February 2014 on public procurement and repealing Directive 2004/18/EC (2) shall apply, with the necessary adaptations.’.

Article 2

This Decision shall enter into force on the day following that of its adoption.
