of 23 April 2024

on the suspension of the approval of a civil aviation security equipment with ‘EU Stamp’ marking

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Commission Implementing Regulation (EU) 2015/1998 of 5 November 2015 laying down detailed measures for the implementation of the common basic standards on aviation security (1), and in particular point 12.0.4.1 of its Annex thereof.

Whereas:

The detailed measures for the implementation of the common basic standards referred to in Article 4(3) of Regulation (EC) No 300/2008 of the European Parliament and of the Council (2) include procedures for approval and use of civil aviation security equipment.

(2)

On this basis Implementing Regulation (EU) 2015/1998 establishes a harmonised regime of approval for the installation of civil aviation security equipment to ensure the best implementation of the common basic standards in aviation security.

(3)

Commission Decision (EU) 2021/2147 (3) establishes a consolidated list of approved civil aviation security equipment with ‘EU Stamp’ marking status to equipment confirmed by the common evaluation process of the European Civil Aviation Conference, for the purpose of installation and use throughout the Union.

In accordance with Implementing Regulation (EU) 2015/1998 and in particular point 12.0.4.1 of its Annex, when the Commission receives information indicating that the equipment does not meet the standard for which it has been approved, it can suspend the ‘EU Stamp’ marking status of security equipment without prior notice either on request from Member States or on its own initiative. Security equipment whose ‘EU Stamp’ marking has been suspended can no longer be deployed and the pieces already installed shall be operated with the addition of compensatory measures, as appropriate.

Technical information received by the Commission shows that a specific configuration of standard C3 Explosive Detection System equipment for cabin baggage (EDSCB), currently listed in the ‘Union database on supply chain security — security equipment’, does not meet the required performance as regards the screening of liquids, aerosols and gels (LAGs) contained in the baggage. Such configuration could continue being operated in accordance with the concept for operations for standard C3 EDSCB, but with a screening limit of the maximum volume of individual LAG containers not to exceed 330 ml.

The consolidated Union database listing equipment allowed for installation and use throughout the Union should be updated accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The ‘EU Stamp’ granted as standard C3 Explosive Detection System equipment for cabin baggage, to the configuration currently listed in the ‘Union database on supply chain security — security equipment’ with designation HI-SCAN 6040 CTiX and with detection algorithm 20-50-00, under the Unique Alphanumeric Identifier EDSCB00110, is suspended. The equipment in this configuration shall only be operated in accordance with concept of operations for standard C3 EDSCB, with a screening limit of the maximum volume of individual LAG containers not to exceed 330 ml.

Article 2

The ‘Union database on supply chain security — security equipment’ shall be updated accordingly.

Article 3

This Decision shall enter into force on the day following that of its publication in the Official Journal of the European Union.
