DECISION OF THE EEA JOINT COMMITTEE
No 88/2007
of 6 July 2007
amending Annex XIII (Transport) to the EEA Agreement
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,
Whereas:

Annex XIII to the Agreement was amended by Decision of the EEA Joint Committee No 54/2007 of 8 June 2007 (1). |

(2) |
Directive 2006/94/EC of the European Parliament and of the Council of 12 December 2006 on the establishment of common rules for certain types of carriage of goods by road (codified version) (2) is to be incorporated into the Agreement. |
|
(3) |
Directive 2006/94/EC repeals the First Council Directive of 23 July 1962 on certain types of carriage of goods by road between Member States (3), which is incorporated into the Agreement and which is consequently to be repealed under the Agreement. |

(4) |
Directive 2006/94/EC is a codified version of the repealed act and therefore the current EEA adaptation to the latter is to be maintained, |
HAS DECIDED AS FOLLOWS:
Article 1
The text of point 25 (First Council Directive of 23 July 1962) of Annex XIII to the Agreement shall be replaced by the following:
‘ 32006 L 0094: Directive 2006/94/EC of the European Parliament and of the Council of 12 December 2006 on the establishment of common rules for certain types of carriage of goods by road (codified version) (OJ L 374, 27.12.2006, p. 5).
The provisions of the Directive shall, for the purposes of this Agreement, be read with the following adaptation:
The provisions of the Directive shall only be applicable to own account transport.’
Article 2
The text of Directive 2006/94/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.
Article 3
This Decision shall enter into force on 7 July 2007, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).
Article 4
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
