Article 3 of Directive 98/37/EC of the European Parliament and of the Council of 22 June 1998 on the approximation of the laws of the Member States relating to machinery and points 1.1.2, 1.2.1, 1.2.2, 1.2.4, 1.2.6, 1.2.7 and 2.3(c) of Annex I thereto
must be interpreted as meaning that a normal stopping device and/or an emergency stop device of a circular wood saw do not meet the health and safety requirements set out in those provisions where, once the machinery’s stop control is engaged, re-actuating, whether deliberately or not, the stopping device concerned, either once continuously or several times consecutively, interrupts the braking of that saw with the result that the blade of that saw does not stop but continues to rotate silently as it slows down, finally stopping after several minutes.
