Penalties, in accordance with the national law, for the unauthorised crossing of external borders at places other than border crossing points or at times other than the fixed opening hours – Article 5(3)

CROATIA
Article 42 of the State Border Control Act (Official Gazette, No 83/13, 27/16, 114/22, 151/22) lays down that a 30-day imprisonment or a fine ranging from EUR 260,00 to EUR 1 320,00 will be imposed on natural persons for a misdemeanour offence if they:

cross or attempt to cross the external border at places other than border crossing points or across a border crossing point outside working hours of the border crossing point, |

(2) |
avoid to undergo border checks or leave the area of a border crossing point before border checks are completed. |
Article 249 (8) of the Aliens Act (Official Gazette, No 133/20, 114/22, 151/22, 40/25) lays down that: ‘(8) A natural person who assists or attempts to assist a third-country national in illegal crossing, transit and illegal stay in the Republic of Croatia shall be punished by imprisonment of up to 60 days or fined in the amount of EUR 3 000,00 for each assisted third-country national’, and paragraph 9 lays down the following: ‘(9) Mandatory confiscation of objects and means of transport shall be imposed for misdemeanour offences referred to in paragraph 8 of this Article if the person who assisted or attempted to assist the third-country national is the owner of the means of transport’.
