Should Article 49 of the Treaty on the Functioning of the European Union (the ‘TFEU’) and Regulation (EU) No 1308/2013 (1) of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007 (‘the CMO Regulation’) be interpreted as precluding a national measure which, in view of the armed conflict and humanitarian catastrophe in Ukraine and with a view to averting their impact on Hungary, and invoking the reduction of food prices to protect Hungarian families, obliges food retailers to offer for sale agricultural products falling within the scope of the CMO Regulation at an authorised price (applying a mandatory profit margin) and in the average daily quantity sold in the reference year, so that the needs of customers are met at all times?

If it is found that the Member State authority imposed the fine and the costs of the proceedings on the trader in breach of EU law, should EU law be interpreted as meaning that, in such a case, the Member State authority, in addition to repaying the fine and the costs of the proceedings, is obliged to pay interest at a rate corresponding to the statutory rate of interest applicable under the general rules?
