Pleas in law and main arguments
In support of the action, the applicant relies on two pleas law.

First plea in law, alleging an infringement of the applicant’s rights of defence. The applicant raises the first plea in law alleging that the defendant infringed the applicant’s rights of defence by failing to give the applicant the opportunity to express its views and to submit supporting evidence before the contested acts were adopted, even within a potentially shortened hearing period, and in the absence of any situation of urgency that would have justified deferring the right to be heard. |

Second plea in law, alleging an error of assessment. The applicant raises the second plea in law alleging that the contested acts do not meet the legal requirements of Article 4x(2)(b) of Council Decision 2014/512/CFSP (3), as amended, and Article 3s(2)(b) of Council Regulation (EU) No 833/2014 (4), as amended, because the vessel ‘NERO’ did not transport crude oil or petroleum products that originate in Russia or are exported from Russia while practicing irregular and high-risk shipping practices as set out in resolution A.1192(33) of the General Assembly of the International Maritime Organisation. |
