annul (i) Council Decision (CFSP) 2023/432 (1) of 25 February 2023 amending Decision 2014/145/CFSP concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine and Council Implementing Regulation (EU) 2023/429 (2) of 25 February 2023, implementing Regulation (EU) No 269/2014 concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine, in so far as they include the appellant in the list of entities made subject to the restrictive measures; (ii) Council Decision (CFSP) 2023/1767 (3) of 13 September 2023, amending Decision 2014/145/CFSP concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine and Council Implementing Regulation (EU) 2023/1765 (4) of 13 September 2023, implementing Regulation (EU) No 269/2014, concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine, in so far as they maintain the appellant in the list of sanctioned entities; (iii) Council Decision (CFSP) 2024/847 (5) of 12 March 2024, amending Decision 2014/145/CFSP concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine and Council Implementing Regulation (EU) 2024/849 (6) of 12 March 2024 implementing Regulation (EU) No 269/2014, concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine, in so far as they maintain the appellant in the list of sanctioned entities; |

order the Council of the European Union to bear the appellant’s costs both concerning the first instance and present appeal proceedings. |
Pleas in law and main arguments
In support of the appeal, the appellant relies on three grounds of appeal.
A first ground of appeal alleging the errors of law and distortions of facts and evidence made by the General Court in rejecting the plea alleging infringement of the rights of defense and of the right to effective judicial protection. The appellant also considers that the General Court misinterpreted and misapplied the principles of the protection of the rights of the defense and of effective judicial protection.
A second ground of appeal alleging the breach of essential procedural requirements by the Council of the European Union in adopting the contested acts in the judgement under appeal, in so far as they concern the appellant. The appellant also relies on the lack of competence of the deciding bodies in such matter.
A third ground of appeal alleging the misinterpretation of the listing criterion (g) under Decision 2014/145/CFSP (7) and breach of the principle of equal treatment as enshrined in Article 21(1) of the Charter of fundamental rights. The appellant also alleges a breach of the principle of legal certainty.
