The publication of the list of residence permits referred to in Article 2(16) of Regulation (EU) 2016/399 of the European Parliament and of the Council of 9 March 2016 on a Union Code on the rules governing the movement of persons across borders (Schengen Borders Code) (2) is based on information communicated by the Member States to the Commission in conformity with Article 39 of the Schengen Borders Code.

In addition to publication in the Official Journal, a regular update is available on the website of the Directorate-General for Migration and Home Affairs.

CZECH REPUBLIC

Replacement of the list published in OJ C 126, 12.4.2021, p. 1

1)   Uniform format (ID card)

Residence permits are issued in the form of an ID card made of a polycarbonate card with biometric features following to a uniform model. The validity period depends on the type of stay, in accordance with Act No. 326/1999 Coll., on the Residence of Foreign Nationals in the Territory of the Czech Republic and on Amendments to Certain Acts, as well as Act No. 325/1999 Coll., the Asylum Act, as amended.

A)   Residence Permit/ Povolení k pobytu

This document can be obtained by third-country nationals with a long-term or permanent residence permit in the Czech Republic, family members of EU, Norwegian, Swiss, Icelandic, and Liechtenstein citizens who do not meet the conditions for issuing a "Permanent Residence Card"/ "Karty trvalého pobytu" or "Residence Card"/ "Pobytové karty" , and persons granted asylum or subsidiary protection.

Since 2 August 2021, the document has also been issued to UK citizens and their family members covered by the Withdrawal Agreement.

The "Remarks"/ "Poznámky" section includes a two-digit code specifying the purpose of stay (see table below). For permits issued for reasons other than employment, the note "Free access to the labour market – YES/NO" / "Volný přístup na trh práce – ANO/NE" is added. The address of residence is provided only for authorisations of the type "PERMANENT STAY" / "TRVALÝ POBYT", "ASYLUM" / "AZYL" , and "SUBSIDIARY PROTECTION" / "DOPLŇKOVÁ OCHRANA".

Other purposes

i)

Residence Permits issued from 4 July 2011 until 26 June 2020 in the form of ID cards in accordance with Council Regulation (EC) No 380/2008 of 18 April 2008 amending Regulation (EC) No 1030/2002 laying down a uniform format for residence permits for third-country nationals. These permits remain valid until June 2030.

Under the heading Type of permit, the relevant type of stay is specified: "Long-term residence"/, "Dlouhodobý pobyt" , "Employee card"/"Zaměstnanecká karta" , "EU Blue Card" /"Modrá karta EU" (Council Directive 2009/50/EC), "ICT" (Intra-Company Transfer Card under Directive 2014/66/EU), "MOBILE ICT" (Intra-Company Transfer Card from another EU Member State under Directive 2014/66/EU), or " Permanent"/"Trvalý".

ii)

Residence Permits issued since 27 June 2020 in the form of ID cards in accordance with Regulation (EU) 2017/1954 of the European Parliament and of the Council of 25 October 2017 amending Council Regulation (EC) No 1030/2002 laying down a uniform format for residence permits for third-country nationals.

B)   Residence Card/ Pobytová karta

Residence Card issued since 2 August 2021 in the form of an ID card in accordance with Regulation (EU) 2017/1954 of the European Parliament and of the Council of 25 October 2017 amending Council Regulation (EC) No 1030/2002 laying down a uniform format for residence permits for third-country nationals. The back of the card is identical to the residence permit (see section A above for more details). Issued only to family members of EU citizens who are not themselves EU citizens.

C)   Permanent Residence Card/ Karta trvalého pobytu

Permanent Residence Card issued since 2 August 2021 in the form of an ID card in accordance with Regulation (EU) 2017/1954 of the European Parliament and of the Council of 25 October 2017 amending Council Regulation (EC) No 1030/2002 laying down a uniform format for residence permits for third-country nationals. The back of the card is identical to the residence permit (see section A above for more details). Issued only to family members of EU citizens who are not themselves EU citizens.

2)   All other documents issued to third-country nationals of equivalent value to a residence permit

A)   Residence Card of a Family Member of a Citizen of the European Union/ Pobytová karta rodinného příslušníka občana Evropské unie

A dark blue document in the form of a booklet. Document issued from 1 January 2013 until 1 August 2021 to family members of EU citizens who have been granted temporary residence in the Czech Republic. The card was valid until 3 August 2023 , after which it was fully replaced by a document with biometric data (see section 1 – uniform format for more details).

B)   Permanent Residence Card/ Průkaz o povolení k trvalému pobytu

i.

Permanent Residence Card is a dark green document in the form of a booklet. Since 2 August 2021, this card has only been issued to citizens of the EU, Switzerland, Norway, Iceland, and Liechtenstein.

Previously, this permanent residence card was also issued to family members of EU, Swiss, Norwegian, Icelandic, and Liechtenstein citizens. However, since 2 August 2021, these family members receive documents with biometric data (see section 1 – uniform format for more details). This also applies to UK citizens and their family members who are covered by the Withdrawal Agreement. Documents issued before 2 August 2021 remain valid until their expiry date.

ii.

Permanent Residence Card of a citizen of the European Union is a red document in the form of a booklet. This type of document was issued to EU citizens until August 2017. It can remain in circulation until 2027.

C)   Residence Permit Card for Foreigners/ Průkaz o povolení k pobytu pro cizince

A light green document in the form of a booklet with red print on the front. Until 14 August 2017, it was issued to citizens of Switzerland, Norway, Iceland, and Liechtenstein with permanent residence in the Czech Republic, as well as their family members with temporary residence permits. Since 15 August 2017, it has been intended only for family members of citizens of these states for temporary residence. The document expired on 3 August 2023 , after which it was fully replaced by documents containing biometric data (see section 1 above – uniform format).

D)   Identity Card/ Identifikační průkaz

Since 15 August 2017, an identity card has been issued with black color inscription on the front side ‘Identity Card and long-term residence permit’ /‘Identifikační průkaz a povolení k pobytu’.

This document is in the form of a paper card sealed in foil, with dimensions of 105 × 74 mm. On the front side, there is a photograph of the holder along with details such as name, nationality, date of birth, gender, function, address, and the card’s validity date. On the back, it is stated that this identity card serves as an official document and proof of identity, as well as proof of long-term residence in the Czech Republic.

The identification card is issued by the Ministry of Foreign Affairs with the following designation:

E)   Confirmation of Electronic Registration for the Extension of Temporary Protection/Potvrzení o provedení elektronické registrace k prodloužení dočasné ochrany

Under Council Implementing Decision (EU) 2024/1836 of 25 June 2024 extending temporary protection as introduced by Implementing Decision (EU) 2022/382 of 4 March 2022 establishing the existence of a mass influx of displaced persons from Ukraine within the meaning of Article 5 of Directive 2001/55/EC and having the effect of introducing temporary protection (OJ L 71, 4.3.2022, p. 1).

According to § 7b of Act No. 24/2025 Coll., amending Act No 65/2022 Coll. on certain measures in connection with the armed conflict on the territory of Ukraine caused by the invasion of the Russian Federation, persons granted temporary protection are allowed to automatically renew their temporary protection permits through electronic registration without having to (re)apply for a new one. Based on the electronic confirmation “Potvrzení o provedení elektronické registrace k prodloužení dočasné ochrany” (the precise title of the document in Czech) completed by 15 March 2025, the foreign national is entitled to stay on the territory of the Czech Republic and move freely within the Schengen area for the purpose of temporary protection until 30 September 2025 . Temporary protecton on the territory of the Czech Republic will be extended until 31 March 2026, by affixing a visa sticker at the Ministry of the Interior on that date.
