Minutes of the sitting of 10 July 2023

1.   Resumption of the session

The session adjourned on Thursday 15 June 2023 was resumed.

2.   Opening of the sitting

The sitting opened at 17.00.

3.   Statements by the President

The President made a statement marking 500 days since the start of Russia's invasion of Ukraine and emphasised Parliament's continued support for and solidarity with Ukraine and its people.

The President also informed the House that it was now 100 days since Evan Gershkovich, a journalist at The Wall Street Journal, had been illegally detained in Russia. The President reiterated her call for his immediate release. She also reminded the House that 300 weeks had passed since the assassination of the Maltese journalist Daphne Caruana Galizia and reaffirmed Parliament's commitment to ensuring that justice would be done.

The President concluded by expressing Parliament's solidarity with the LGBTIQ community in the wake of the violent disruption of the Pride festival in Tbilisi, Georgia.

4.   Approval of the minutes of the previous sitting

The minutes of the previous sitting were approved.

5.   Composition of Parliament

Álvaro Amaro had resigned as an MEP with effect from 7 July 2023.

Peter van Dalen had resigned as an MEP with effect from 4 September 2023.

The JURI Committee considered that both resignations were in compliance with the Act of 20 September 1976 concerning the election of the members of the European Parliament by direct universal suffrage.

Under Rule 4, Parliament established that the seats concerned would fall vacant with effect from 7 July 2023 and 4 September 2023 respectively and would inform the Member States concerned thereof.

The German competent authorities had given notice of the election of Thomas Rudner to replace Ismail Ertug as Member of Parliament with effect from 3 July 2023.

The Portuguese competent authorities had given notice of the election of Carlos Coelho to replace Álvaro Amaro as Member of Parliament with effect from 7 July 2023.

Parliament took due note of their election.

Under Rule 3(2), until such time as their credentials had been verified or a ruling had been given on any dispute, and provided that they had previously made a written declaration stating that they did not hold any office incompatible with that of Member of the European Parliament, Thomas Rudner and Carlos Coelho would take their seats in Parliament and on its bodies and would enjoy all the rights attaching thereto.

6.   Verification of credentials

On the basis of a unanimous proposal by the JURI Committee at its meeting of 27 June 2023, Parliament verified the credentials and confirmed the mandate of Nikos Papandreou with effect from 3 May 2023, in accordance with Rule 3(4).

7.   Request for the waiver of immunity

The Greek authorities had sent the President a request for Georgios Kyrtsos's immunity to be waived in connection with criminal proceedings pending in Greece.

Pursuant to Rule 9(1), the request had been referred to the committee responsible, in this case the JURI Committee.

8.   Composition of committees and delegations

The S&D and The Left groups had notified the President of the following decisions changing the composition of the committees and delegations:

AFET Committee: Alessandra Moretti to replace Giuliano Pisapia

TRAN Committee: Thomas Rudner

Delegation to the EU-Ukraine Parliamentary Association Committee: Anja Hazekamp was no longer a member

Delegation for relations with the People's Republic of China: Thomas Rudner

Delegation to the Euro-Latin American Parliamentary Assembly: Daniela Rondinelli

Delegation to the Euronest Parliamentary Assembly: Anja Hazekamp was no longer a member

The decisions took effect as of that day.

9.   Negotiations ahead of Parliament's first reading (Rule 71)

The committees responsible had decided to enter into interinstitutional negotiations pursuant to Rule 71 on the basis of the following reports:

In accordance with Rule 71(2), requests for the decisions to be put to the vote could be submitted until midnight the following day, 11 July 2023.

Negotiations could start at any time after the expiry of that deadline if no request for a vote on the decision to enter into negotiations had been made.

10.   Signing of acts adopted in accordance with the ordinary legislative procedure (Rule 79)

Since the adjournment of the session on 15 June 2023, the President of Parliament, together with the President of the Council, had signed the following act adopted under the ordinary legislative procedure:

Regulation of the European Parliament and of the Council on the European Union Drugs Agency (EUDA) and repealing Regulation (EC) No 1920/2006 (00016/2023/LEX — C9-0212/2023 — 2022/0009(COD)).

On 12 July 2023, the President of Parliament, together with the President of the Council, would sign the following acts adopted under the ordinary legislative procedure:

Directive of the European Parliament and of the Council laying down harmonised rules on the designation of designated establishments and the appointment of legal representatives for the purpose of gathering electronic evidence in criminal proceedings (00003/2023/LEX — C9-0243/2023 — 2018/0107(COD));

Regulation of the European Parliament and of the Council on European Production Orders and European Preservation Orders for electronic evidence in criminal proceedings and for the execution of custodial sentences following criminal proceedings (00004/2023/LEX — C9-0244/2023 — 2018/0108(COD));

Regulation of the European Parliament and of the Council concerning batteries and waste batteries, amending Directive 2008/98/EC and Regulation (EU) 2019/1020 and repealing Directive 2006/66/EC (00002/2023/LEX — C9-0224/2023 — 2020/0353(COD));

Decision of the European Parliament and of the Council providing macro-financial assistance to the Republic of North Macedonia (00023/2023/LEX — C9-0245/2023 — 2023/0034(COD)).

11.   Corrigendum (Rule 241)

The committee responsible had forwarded the following corrigendum to a text adopted by Parliament:

AGRI Committee — Corrigendum P9_TA(2021)0458(COR01) to Regulation (EU) 2021/2117 of the European Parliament and of the Council of 2 December 2021 amending Regulations (EU) No 1308/2013 establishing a common organisation of the markets in agricultural products, (EU) No 1151/2012 on quality schemes for agricultural products and foodstuffs, (EU) No 251/2014 on the definition, description, presentation, labelling and the protection of geographical indications of aromatised wine products and (EU) No 228/2013 laying down specific measures for agriculture in the outermost regions of the Union (OJ L 435, 6.12.2021, p. 262) — (position of the European Parliament adopted at first reading on 23 November 2021 with a view to the adoption of the above regulation P9_TA(2021)0458 (COM(2018)0394 — C8-0246/2018 — 2018/0218(COD)).

This corrigendum would be deemed approved unless a request for a vote was made within 24 hours, in accordance with Rule 241(4).

12.   Proposals for Union acts

The President announced that she had declared the following proposals for Union acts admissible under Rule 47(2):
