Re:

By its application based on Article 263 TFEU, the applicant seeks annulment of Commission Implementing Decision C(2022) 9544 final of 12 December 2022 granting marketing authorisation under Regulation (EC) No 726/2004 of the European Parliament and of the Council for Dimethyl fumarate Teva – dimethyl fumarate as a medicinal product for human use.

Operative part of the order

1.

There is no longer any need to adjudicate on the action.

2.

Biogen Netherlands BV and the European Commission shall bear their own costs, including those relating to the application to intervene of Teva GmbH.

3.

Teva shall bear its own costs relating to the application to intervene.
