The applicants claim that the Court should:

annul section 3 of ECB Decision ECB-SSM-2023-FRBPC-114 of 30 November 2023 (taken together with its annexes), in so far as it prescribes measures to be taken regarding irrevocable payment commitments in respect of the deposit guarantee schemes or the resolution fund;

order the defendant to pay all the costs.

Pleas in law and main arguments

In support of the action, the applicants rely on four pleas in law which are identical or similar to those relied on in Case T-186/22, BNP Paribas v ECB.
