VERORDENING VAN DE RAAD

tot wijziging van de lijsten van insolventieprocedures, liquidatieprocedures en curatoren die zijn opgenomen in de bijlagen A, B en C bij Verordening (EG) nr. 1346/2000 betreffende insolventieprocedures

DE RAAD VAN DE EUROPESE UNIE,

Gelet op het Verdrag tot oprichting van de Europese Gemeenschap,

Gelet op Verordening (EG) nr. 1346/2000 van de Raad van 29 mei 2000 betreffende insolventieprocedures[1], en met name op artikel 45,

Gezien het voorstel van de Commissie[2],

Overwegende hetgeen volgt:

In de bijlagen bij Verordening (EG) nr. 1346/2000 zijn de benamingen opgenomen die in de nationale wetgeving van de lidstaten worden gebruikt voor de procedures en de curatoren waarop deze verordening van toepassing is. Bijlage A bij Verordening (EG) nr. 1346/2000 bevat een lijst van de in artikel 2, onder a), van de verordening bedoelde insolventieprocedures. Bijlage B bevat een lijst van de in artikel 2, onder c), bedoelde liquidatieprocedures en bijlage C bevat een lijst van de in artikel 2, onder b), bedoelde curatoren.

De bijlagen A, B en C bij Verordening (EG) nr. 1346/2000 werden gewijzigd bij de Toetredingsakte van 2003 teneinde de insolventieprocedures, de liquidatieprocedures en de curatoren van de toetredende landen op te nemen.

België, Spanje, Italië, Letland, Litouwen, Malta, Hongarije, Oostenrijk, Polen, Portugal en het Verenigd Koninkrijk hebben de Commissie overeenkomstig artikel 45 van Verordening (EG) nr. 1346/2000 in kennis gesteld van teksten tot wijziging van de in de bijlagen A, B en C bij deze verordening opgenomen lijsten.

Verordening (EG) nr. 1346/2000 dient dus dienovereenkomstig te worden gewijzigd,

HEEFT DE VOLGENDE VERORDENING VASTGESTELD:

Artikel 1

Verordening (EG) nr. 1346/2000 wordt als volgt gewijzigd:

(1) Bijlage A wordt vervangen door de tekst in bijlage A bij deze verordening;

(2) Bijlage B wordt vervangen door de tekst in bijlage B bij deze verordening;

(3) Bijlage C wordt vervangen door de tekst in bijlage C bij deze verordening.

Artikel 2

Deze verordening treedt in werking op de dag volgende op die van haar bekendmaking in het Publicatieblad van de Europese Unie .

Deze verordening is verbindend in al haar onderdelen en is rechtstreeks toepasselijk in elke lidstaat.
