EXPLANATORY MEMORANDUM

Point 28 of the Interinstitutional Agreement of 17 May 2006 between the European Parliament, the Council and the Commission on budgetary discipline and sound financial management[1] allows for the mobilisation of the European Globalisation Adjustment Fund (EGF) through a flexibility mechanism, within the annual ceiling of EUR 500 million over and above the relevant headings of the financial framework.

The rules applicable to the contributions from the EGF are laid down in Regulation (EC) No 1927/2006 of the European Parliament and of the Council of 20 December 2006 on establishing the European Globalisation Adjustment Fund[2].

On 28 December 2011, Spain submitted application EGF/2011/017 ES/Aragón construction for a financial contribution from the EGF, following redundancies in 377 enterprises operating in the NACE Revision 2 Division 41 ('Construction of buildings')[3] in the NUTS II region of Aragón (ES24) in Spain.

After a thorough examination of this application, the Commission has concluded in accordance with Article 10 of Regulation (EC) No 1927/2006 that the conditions for a financial contribution under this Regulation are met.

1.           The application was presented to the Commission on 28 December 2011 and supplemented by additional information up to 23 March 2012.

2.           The application meets the conditions for deploying the EGF as set out in Article 2(b) of Regulation (EC) No 1927/2006, and was submitted within the deadline of 10 weeks referred to in Article 5 of that Regulation.

Link between the redundancies and major structural changes in world trade patterns due to globalisation or the global financial and economic crisis

3.           In order to establish the link between the redundancies and the global financial and economic crisis, Spain argu es that the construction sector has been severely affected by the crisis. Loans to the construction sector and to individuals have been drastically reduced and the demand for new houses decreased due to declining consumer confidence and the lack of cash.

4.           The Commission recognised in its Economic Recovery Plan that the construction industry in the EU had seen demand plummet as a result of the crisis. Available data confirms the significant downturn in the construction sector, which fell in the EU-27 for eight consecutive quarters (Q1/2009 to Q4/2010) compared with the same period of the previous year, mainly due to the decrease in private investment in the residential sector.

5.           In 2009 construction output in Spain followed the same negative trend as the EU-27 average. However, in 2010 and the first half of 2011 the downturn in the Spanish construction sector was further exacerbated.

6.           Other indicators, such as the number of building permits or the number of buildings started, give further evidence of the decline in demand for buildings (houses) in Spain. The number of building permits granted in Spain decreased by 75,6 % in 2009 and 82,8 % in 2010 compared with 2007, the last pre-crisis year. The number of buildings started decreased by 52,2 % in 2009 compared with 2008 and by 76,7 % compared with 2007.

7.           The arguments presented in previous cases[5] concerning the construction of buildings sector and in which the redundancies were a direct result of the crisis remain valid.

Demonstration of the number of redundancies and compliance with the criteria of Article 2(b)

8.           Spain submitted this application under the intervention criteria of Article 2(b) of Regulation (EC) No 1927/2006, which requires at least 500 redundancies over a nine-month period in enterprises operating in the same NACE Revision 2 Division in one region or two contiguous regions at NUTS II level in a Member State.

9.           The application cites 836 redundancies in 377 enterprises operating in the NACE Revision 2 Division 41 ('Construction of buildings') in the NUTS II region of Aragón (ES24) during the nine-month reference period from 31 January 2011 to 31 October 2011. Of these redundancies 767 were calculated in accordance with the second indent of the second paragraph of Article 2 of Regulation (EC) No 1927/2006. A further 69 redundancies were calculated in accordance with the third indent of the same paragraph. The Commission has received the confirmation required under the third indent of the second paragraph of Article 2(2) that this is the actual number of redundancies effected.

Explanation of the unforeseen nature of those redundancies

10.         The Spanish authorities argue that the financial and economic crisis has led to a sudden collapse of the world economy with enormous impact on many sectors. The nature of the recession as far as the construction sector is concerned, with a sudden tightening of conditions for access to financial credit and a dramatic slowdown in new orders, was unprecedented in recent times. As a result of the crisis, economic developments since 2008 have not been following the trends of previous years. The redundancies in the construction industry could not therefore have been foreseen or easily prevented.

16.         In accordance with Article 7 of Regulation (EC) No 1927/2006, Spain has confirmed that a policy of equality between women and men as well as non-discrimination has been applied, and will continue to apply, during the various stages of the implementation of and, in particular, in access to the EGF.

Description of the territory concerned and its authorities and stakeholders

17.         The territory concerned by the redundancies is the autonomous community of Aragón. Most of the territory of the region has a population density lower than the EU average of 112 inhabitants per km2 while 60 % of the total population of the territory is concentrated in the town of Zaragoza and its surrounding area. Aragon's economy based traditionally on cereal crops and sheep farming, has been transformed over the last two or three decades by the rise of the industrial sector, services and trade, and followed by tourism, in particular winter sports tourism. Aragón accounts for 3 % of the Spanish GDP.

18.         The main stakeholders are the Departamento de Economía, Hacienda y Empleo del Gobierno de Aragón (Finance and Employment Regional Ministry) and the Instituto Aragonés de Empleo-INAEM (labour services of the Aragón autonomous government); the trade unions Confederación Sindical de Comisiones Obreras CC.OO Aragón and Unión General de Trabajadores-UGT Aragón; and two employers' organizations: Confederación de Empresarios de Aragón-CREA, and Confederación de la Pequeña y Mediana Empresa Aragonesa-CEPYME Aragón.

Expected impact of the redundancies as regards local, regional or national employment

19.         The Spanish authorities argue that the redundancies in the construction sector will aggravate the unemployment situation, which has already deteriorated as a result of the financial and economic crisis. During the years 2008 and 2009, unemployment increased dramatically in Aragón, from 40 000 to 80 000 unemployed people. In the following years unemployment continued its up trend and by the end of 2011 the number of workers registered in the public labour offices was close to 100 000. Of these, 15 % were workers made redundant in the construction sector.

20.         Due to the low population density in most of the territory concerned by this application (between 3 and 54 inhabitants per km2) and the risk of depopulation, layoffs have a highly negative impact on this region and might jeopardize the efforts made to encourage the population to remain in the territory. Furthermore, following other mass redundancies in the Aragón region, Spain submitted applications EGF/2008/004 ES Castilla y León & Aragón (1 082 redundancies in the automotive industry of which 594 occurred in Aragón) and EGF/2010/016 ES Aragón retail (1 154 redundancies in the retail sector) [13] for financial contributions from the EGF.

Co-ordinated package of personalised services to be funded and a breakdown of its estimated costs, including its complementarity with actions funded by the Structural Funds

21.         All the following measures combine to form a co-ordinated package of personalised services aimed at re-integrating the workers into the labour market. They are organised in four areas:

Guidance, counselling and job search.

– Welcome session, occupational guidance and profiling: The first measure provided to all participants includes the profiling of the workers as well as information on available jobs, on skills and training requirements, on available training programmes and on incentives.

– Training in job-search techniques, self-employment and social skills: The workers will participate in workshops focused on self-employment and the promotion of entrepreneurship or they will be trained in job-search skills. This measure will also aim to improve the self-knowledge of the participants and to reinforce their self-esteem and social skills.

Training and re-training.

– General training and re-training: This measure offers diverse pathways of training. The workers will be given the opportunity to follow one or more of the following courses: (1) Information and communication technologies (ICT) basic or intermediate; (2) Training in vocational skills: the participants in this measure will be trained in job skills currently in demand; (3) Training with commitment of hiring: the training courses will be designed to cater for the identified needs of local enterprises, which will in turn undertake to employ some of the workers participating in this action; (4) Training in personal development: the participants will be trained in transversal skills, including decision-making process, conflict resolution, adaptation to change, interpersonal relations skills, etc. -- this training aims to improve the self-esteem of its participants and their interpersonal communication skills or other transversal skills, in order to facilitate their reintegration into employment.

– Recognition of prior experience: This covers the evaluation of prior knowledge and experience of each individual worker as well as the identification of areas where further training is required. The participants after concluding the recognition of prior experience procedure will receive an official attestation of skills and knowledge issued by the Agencia de Cualificaciones Profesionales de Aragón.

Reintegration into employment.

– Intensive job-search assistance: This will include an active search for local and regional employment opportunities, exploring new openings for employment such as green energy, organic trade, etc., and the matching of available jobs with the job seekers.

– Tutoring after reintegration into work: This will prevent possible problems arising in the new jobs: the workers reintegrated into employment will be guided during the first months in their new jobs.

Incentives.

– Job-search allowance: The workers following the agreed pathway to reinsertion will receive an allowance of EUR 300, paid in two instalments of EUR 150.

– Contribution for carers of dependent persons: Workers with dependent persons (children, elderly or disabled persons) will receive one-off payment of EUR 150 as a contribution to the expenses for carers of dependent persons, conditional upon their participation in the measures. This aims to cover the additional costs faced by the workers with caring responsibilities in order to avail themselves of training or other measures.

– Outplacement incentive: A wage subsidy of EUR 200 per month for a maximum of three months will be paid to workers who return to employment. The subsidy is designed to encourage their quick reintegration into a job and to stimulate workers, particularly those who are older, to remain in the labour market.

– Outplacement incentives for self-employed worker: A wage subsidy of EUR 400 per month for a maximum of three months will be paid to those workers who return to employment as self-employed workers. The subsidy is designed to support them during the start-up period of their activity as self-employed.

22.         The expenditure for implementing the EGF, which is included in the application in accordance with Article 3 of Regulation (EC) No 1927/2006, covers preparatory, control activities as well as information and publicity.

23.         The personalised services presented by the Spanish authorities are active labour market measures within the eligible actions defined by Article 3 of Regulation (EC) No 1927/2006. The Spanish authorities estimate the total costs of these services at EUR 1 971 530 and the expenditure for implementing the EGF at EUR 28 470 (1,42 % of the total amount). The total contribution requested from the EGF is EUR 1 300 000 (65 % of the total costs).

24.         Spain confirms that the measures described above are complementary with actions funded by the Structural Funds. Spain will put in place the necessary control procedures to eliminate any risk of double funding and will also ensure a clear audit trail for EGF funded activities.

Date(s) on which the personalised services to the affected workers were started or are planned to start

25.         Spain started the personalised services to the affected workers included in the co-ordinated package proposed for co-financing to the EGF on 28 December 2011. This date therefore represents the beginning of the period of eligibility for any assistance that might be awarded from the EGF.

Procedures for consulting the social partners

26.         The social partners CREA, CEPYME Aragón, UGT and CCOO were consulted twice: on 30 June and on 11 November 2011, in the framework of the Guidance Committee for Intermediation and Job Placement of the Economic and Social Agreement for the Development of Aragón 2008-2011. In the first meeting the social partners agreed to the submission of an application for EGF co-funding. In the second meeting the draft application was discussed, in particular the package of personalised services to be provided to the workers.

27.         The Spanish authorities confirmed that the requirements laid down in national and EU legislation concerning collective redundancies have been complied with.

Information on actions that are mandatory by virtue of national law or pursuant to collective agreements

28.         As regards the criteria contained in Article 6 of Regulation (EC) No 1927/2006, the Spanish authorities in their application:

· confirmed that the financial contribution from the EGF does not replace measures which are the responsibility of companies by virtue of national law or collective agreements;

· demonstrated that the actions provide support for individual workers and are not to be used for restructuring companies or sectors;

· confirmed that the eligible actions referred to above do not receive assistance from other EU financial instruments.

Management and control systems

29.         Spain has notified the Commission that the financial contribution will be managed and controlled by the same bodies that manage and control the ESF. The Instituto Aragonés de Empleo (INAEM) will be the intermediate body for the managing authority.

Financing

30.         On the basis of the application from Spain, the proposed contribution from the EGF to the coordinated package of personalised services (including expenditure to implement EGF) is EUR 1 300 000, representing 65 % of the total cost. The Commission's proposed allocation under the Fund is based on the information made available by Spain.

31.         Considering the maximum possible amount of a financial contribution from the EGF under Article 10(1) of Regulation (EC) No 1927/2006, as well as the scope for reallocating appropriations, the Commission proposes to mobilise the EGF for the total amount referred to above, to be allocated under heading 1a of the financial framework.

32.         The proposed amount of financial contribution will leave more than 25 % of the maximum annual amount earmarked for the EGF available for allocations during the last four months of the year, as required by Article 12(6) of Regulation (EC) No 1927/2006.

33.         By presenting this proposal to mobilise the EGF, the Commission initiates the simplified trialogue procedure, as required by Point 28 of the Interinstitutional Agreement of 17 May 2006, with a view to securing the agreement of the two arms of the budgetary authority on the need to use the EGF and the amount required. The Commission invites the first of the two arms of the budgetary authority that reaches agreement on the draft mobilisation proposal, at appropriate political level, to inform the other arm and the Commission of its intentions. In case of disagreement by either of the two arms of the budgetary authority, a formal trialogue meeting will be convened.

34.         The Commission presents separately a transfer request in order to enter in the 2012 budget specific commitment appropriations, as required in Point 28 of the Interinstitutional Agreement of 17 May 2006.

Source of payment appropriations

35.         Appropriations from the EGF budget line will be used to cover the amount of EUR 1 300 000 needed for the present application.

Proposal for a

DECISION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL

on the mobilisation of the European Globalisation Adjustment Fund in accordance with point 28 of the Interinstitutional Agreement of 17 May 2006 between the European Parliament, the Council and the Commission on budgetary discipline and sound financial management (application EGF/2011/017 ES/Aragón Construction from Spain)

THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to the Interinstitutional Agreement of 17 May 2006 between the European Parliament, the Council and the Commission on budgetary discipline and sound financial management[14], and in particular point 28 thereof,

Having regard to Regulation (EC) No 1927/2006 of the European Parliament and of the Council of 20 December 2006 establishing the European Globalisation Adjustment Fund[15], and in particular Article 12(3) thereof,

Having regard to the proposal from the European Commission[16],

Whereas:

(1)       The European Globalisation Adjustment Fund (EGF) was established to provide additional support for workers made redundant as a result of major structural changes in world trade patterns due to globalisation and to assist them with their reintegration into the labour market.

(2)       The scope of the EGF was broadened for applications submitted from 1 May 2009 to 30 December 2011 to include support for workers made redundant as a direct result of the global financial and economic crisis.

(3)       The Interinstitutional Agreement of 17 May 2006 allows the mobilisation of the EGF within the annual ceiling of EUR 500 million.

(4)       Spain submitted an application to mobilise the EGF, in respect of redundancies in 377 enterprises operating in the NACE Revision 2 Division 41 ('Constrcution of buidings') in the NUTS II region of Aragón (ES24), on 28 December 2011 and supplemented it by additional information up to 23 March 2012. This application complies with the requirements for determining the financial contributions as laid down in Article 10 of Regulation (EC) No 1927/2006. The Commission, therefore, proposes to mobilise an amount of EUR 1 300 000.

(5)       The EGF should, therefore, be mobilised in order to provide a financial contribution for the application submitted by Spain,

HAVE ADOPTED THIS DECISION:

Article 1

For the general budget of the European Union for the financial year 2012, the European Globalisation Adjustment Fund (EGF) shall be mobilised to provide the sum of EUR 1 300 000 in commitment and payment appropriations.
