APPLICATION for a declaration that, by making, by means of the legislation of certain Länder , personal protective equipment for firefighters subject to additional requirements, although it complies with the requirements of Council Directive 89/686/EEC of 21 December 1989 on the approximation of the laws of the Member States relating to personal protective equipment (OJ 1989 L 399, p. 18), and bears the EC marking, the Federal Republic of Germany has failed to fulfil its obligations under Articles 1 and 4 of that directive,THE COURT (Fifth Chamber),,
having regard to the Report for the Hearing,
after hearing oral argument from the parties at the hearing on 24 October 2002,after hearing the Opinion of the Advocate General at the sitting on 10 December 2002,
