    of 21 October 2002

    amending Joint Action 2001/760/CFSP concerning the appointment of the Special Representative of the European Union in the Former Yugoslav Republic of Macedonia

    THE COUNCIL OF THE EUROPEAN UNION,

    Having regard to the Treaty on European Union, and in particular Article 14 and Article 18(5) thereof,

    Whereas:

    (1) On 29 October 2001 the Council adopted Joint Action 2001/760/CFSP(1) concerning the appointment of Mr Alain Le Roy as the Special Representative of the European Union in the Former Yugoslav Republic of Macedonia (FYROM) with a view, in particular, to establishing and maintaining close contact with the government of the FYROM and with the parties involved in the political process and to offer the European Union's advice and facilitation in the political process.

    (2) On 25 June 2002 the Council adopted Joint Action 2002/497/CFSP(2) extending the mandate of the Special Representative of the European Union in FYROM, which expires on 31 December 2002.

    (3) Following Alain Le Roy's request that his mission be terminated on 31 October 2002, the Council agreed on 30 September 2002 to appoint Alexis Brouhns as the new EU Special Representative resident in Skopje.

    (4) In accordance with the guidelines on appointing procedure and administrative arrangements of EU Special Representatives adopted by the Council on 30 March 2000, Member States' and the Commission's missions can provide, on request, from their own resources appropriate and reasonable support to the mission of the Special Representative,

    HAS ADOPTED THIS JOINT ACTION:

    Article 1

    Joint Action 2001/760/CFSP is hereby amended as follows:

    1. Article 1 shall be replaced by the following Article: "Article 1

    Mr. Alexis Brouhns is hereby appointed EU Special Representative in FYROM.";

    2. the following sentence shall be added to the end of paragraph 2 of Article 3: "From the moment that Mr Le Roy ceases his activities as EU Special Representative, France shall no longer take on any of the administrative expenditure linked to the functioning of the EU Special Representative."

    Article 2

    This Joint Action shall enter into force on 1 November 2002.

    Article 3

    This Joint Action shall be published in the Official Journal.
