    In Case T-113/02: Gustaaf van Dyck, an official of the Commission of the European Communities, residing in Wuustwezel (Belgium), represented by S. Corbanie, lawyer, and by A.E. Bywater, Solicitor, against Commission of the European Communities (Agents: F. Clotuche-Duvieusart and H.M.H. Speyart), application for annulment of the Commission's decision of 10 January 2002 rejecting the complaint of 14 August 2001, of the Commission's decision of 5 July 2001 rejecting the informal appeal of 1 July 2001 and of the Commission's alleged decision of unknown date revising the applicant's staff report, the Court of First Instance (Fourth Chamber), composed of H. Legal, President, and V. Tiili and M. Vilaras, Judges; H. Jung, Registrar, made an order on 16 January 2004, the operative part of which is as follows:

    1.

    The application is rejected as inadmissible;

    2.

    The parties shall bear their own costs.
