Title: "Anstaltslast and Gewährträgerhaftung - State guarantees for public credit institutions in Germany"

Objective: Support the public credit institutions in their economic functioning

Legal basis: Anstaltslast: General principle of law, explicitly codified only in some relevant laws of similar wording (e.g. § 3(2) Brandenburgisches Sparkassengesetz: "Der Gewährträger stellt sicher, dass die Sparkasse ihre Aufgaben erfüllen kann")

Gewährträgerhaftung: Provisions of similar wording in the respective regional (Länder) laws as regards Landesbank, savings banks and regional special credit institutions and in the federal laws as regards federal special credit institutions (e.g. § 5 Niedersächsisches Landesbankgesetz: "Für die Verbindlichkeiten der Bank haften die Gewährträger gesamtschuldnerisch, soweit die Befriedigung aus dem Vermögen der Bank nicht möglich ist")

Other information: Sweden has accepted the appropriate measures proposed by the Commission on 11 July 2001. For practical reasons, accepted by the Commission on 30 January 2002, Sweden did not commit itself to refuse new beneficiaries from the date of 11 July 2001 until 31 December 2001, date at which the fiscal regime applicable to foreign insurance companies has been repealed

Budget: The total budget for 2001 is increased to EUR 27,23 million. The budget for persons purchasing a wind turbine reamins the same at EUR 5,6 million. The budget for the year 2002 and later will be around EUR 32 million per year

Aid intensity or amount: Between 14,5 % and 18,5 %, for wind turbines 20 % maximum
