Summary

A Member State which simply prohibits imports of live European freshwater crayfish from Member States or from non-member countries in free circulation in other Member States in so far as they are not for the purpose of research and teaching when, in order to prevent the risks of crayfish plague and faunal distortion, it could have limited its measures to cause less serious restrictions on intra-Community trade, such as submitting consignments of imported crayfish to health checks and only carrying out checks by sample if such consignments were accompanied by a health certificate, or confining itself to regulating the marketing of crayfish in its territory, acts in breach of its obligations under Articles 30 and 36 of the Treaty.
