DECIZIA DE PUNERE ÎN APLICARE (UE) 2020/1715 A COMISIEI

din 16 noiembrie 2020

de modificare a anexei la Decizia de punere în aplicare (UE) 2020/1606 privind anumite măsuri provizorii de protecție împotriva gripei aviare înalt patogene de subtip H5N8 în Țările de Jos

COMISIA EUROPEANĂ,

având în vedere Tratatul privind funcționarea Uniunii Europene,

având în vedere Directiva 89/662/CEE a Consiliului din 11 decembrie 1989 privind controlul veterinar în cadrul schimburilor intracomunitare în vederea realizării pieței interne (1), în special articolul 9 alineatul (3),

având în vedere Directiva 90/425/CEE a Consiliului din 26 iunie 1990 privind controalele veterinare și zootehnice aplicabile în schimburile din cadrul Uniunii cu anumite animale vii și produse în vederea realizării pieței interne (2), în special articolul 10 alineatul (3),

întrucât:

Decizia de punere în aplicare (UE) 2020/1606 a Comisiei (3) a fost adoptată ca urmare a apariției unui focar epidemic de gripă aviară înalt patogenă (HPAI) de subtip H5N8 într-o exploatație în care se cresc păsări de curte din provincia Gelderland a Țărilor de Jos și a stabilirii unor zone de protecție și de supraveghere de către autoritatea competentă a statului membru respectiv în conformitate cu Directiva 2005/94/CE a Consiliului (4).

Decizia de punere în aplicare (UE) 2020/1606 prevede faptul că zonele de protecție și de supraveghere stabilite de Țările de Jos în conformitate cu Directiva 2005/94/CE trebuie să cuprindă cel puțin zonele menționate ca zone de protecție și de supraveghere în anexa la respectiva decizie de punere în aplicare.

Anexa la Decizia de punere în aplicare (UE) 2020/1606 a fost modificată recent prin Decizia de punere în aplicare (UE) 2020/1670 a Comisiei (5), ca urmare a apariției unui nou focar epidemic de gripă aviară înalt patogenă de subtip H5N8 la păsări de curte din provincia Gelderland a Țărilor de Jos care trebuia să fie reflectat în anexa respectivă.

De la data adoptării Deciziei de punere în aplicare (UE) 2020/1670, Țările de Jos au notificat Comisiei apariția unui focar de HPAI de subtip H5N8 într-o exploatație în care se cresc păsări de curte din provincia Groningen și au luat măsurile necesare în conformitate cu Directiva 2005/94/CE, inclusiv stabilirea unor zone de protecție și de supraveghere în jurul acestui nou focar epidemic.

Comisia a examinat măsurile respective în colaborare cu Țările de Jos și admite faptul că limitele zonelor de protecție și de supraveghere stabilite de autoritatea competentă din statul membru respectiv se află la o distanță suficientă față de orice exploatație în care a fost confirmat un focar epidemic de HPAI de subtip H5N8.

Pentru a se preveni orice perturbări inutile ale comerțului din Uniune și pentru a se evita impunerea de către țări terțe a unor bariere nejustificate în calea comerțului este necesar să se descrie rapid la nivelul Uniunii, în colaborare cu Țările de Jos, noile zone de protecție și de supraveghere stabilite în statul membru respectiv în conformitate cu Directiva 2005/94/CE. Prin urmare, este necesar ca zonele de protecție și de supraveghere menționate pentru Țările de Jos în anexa la Decizia de punere în aplicare (UE) 2020/1606 să fie modificate.

În consecință, până la următoarea reuniune a Comitetului permanent pentru plante, animale, produse alimentare și hrană pentru animale, este necesar ca anexa la Decizia de punere în aplicare (UE) 2020/1606 să fie modificată pentru a se actualiza regionalizarea la nivelul Uniunii și a se ține cont de noile zone de protecție și de supraveghere stabilite în conformitate cu Directiva 2005/94/CE de către Țările de Jos și a duratei restricțiilor aplicabile acestora.

(8)	Prin urmare, este necesar ca Decizia de punere în aplicare (UE) 2020/1606 să fie modificată în consecință.

(9)	Având în vedere caracterul urgent al situației epidemiologice din Uniune în ceea ce privește răspândirea HPAI de subtip H5N8, este important ca modificările anexei la Decizia de punere în aplicare (UE) 2020/1606 efectuate prin prezenta decizie să intre în vigoare cât mai curând posibil.

(10)	Prezenta decizie urmează să fie revizuită la următoarea reuniune a Comitetului permanent pentru plante, animale, produse alimentare și hrană pentru animale,

ADOPTĂ PREZENTA DECIZIE:

Articolul 1

Anexa la Decizia de punere în aplicare (UE) 2020/1606 se înlocuiește cu textul anexei la prezenta decizie.

Articolul 2

Prezenta decizie se adresează Regatului Țărilor de Jos.
