SPRAWOZDANIE ROCZNE NA TEMAT STOSUNKÓW Z PARLAMENTAMI KRAJOWYMI ZA 2005 R.

1. Wprowadzenie

„Powodowana pragnieniem zwiększenia uczestnictwa w dialogu o Europie, w dyskusji i debacie publicznej, a zarazem poprawy jakości wymiany informacji, przemyśleń i punktów widzenia na te zagadnienia"[1], Komisja zwróciła swoją uwagę 2005 r. na zasady, na jakich opierają się jej stosunki z parlamentami krajowymi. W dniu 9 lutego 2005 r. Margot Wallström przedstawiła kolegium dziesięć konkretnych celów wyznaczonych na nadchodzący rok (zob. poniżej), wraz z bardziej ogólnymi celami w dziedzinie stosunków z obywatelami i wybranymi przez nich przedstawicielami, wyznaczające kierunek działań w tej dziedzinie.

Zadaniem niniejszego rocznego sprawozdania jest wypełnienie jednego z wyznaczonych konkretnych celów. W zwartej, opartej na faktach formie odnosi się ponadto do szeregu dokumentów i protokołów opracowanych przez Sekretariat Generalny.

Rok 2005 dzieli się na okresy: przed i po referendach. O ile definiując swą „koncepcję współpracy z parlamentami krajowymi” Komisja zamierzała wprowadzić w życie zasady zarządzania, o tyle przed wynikami referendów zakładała rychłe wejście w życie Konstytucji. Od tego czasu, jak powszechnie wiadomo, idea Konstytucji została uśpiona, a Unia weszła w okres refleksji.

Tymczasem stosunki z parlamentami krajowymi są intensywnie rozwijane.

Komisja nie może pozostać obojętna ani bierna wobec przedstawicielstw zgromadzeń narodowych 21 państw członkowskich w Brukseli. Od czasu rozszerzenia nie może ona nie dostrzegać rozszerzenia wachlarza procedur uprzedniej weryfikacji parlamentarnej; tym bardziej w okresie refleksji nie może ona zaniedbywać wymiany poglądów z parlamentami krajowymi.

Komisja chciałaby, aby nowa koncepcja współpracy z parlamentami krajowymi w pełni zachowywała równowagę instytucjonalną. Komisja nie kwestionuje tak zwanych stosunków trójkąta instytucjonalnego. W odniesieniu do dialogu parlamentarnej reprezentacji UE, pierwszym uczestnikiem pozostaje Parlament Europejski. Podobnie, gdy sprawa dotyczy przedstawicielstw państw członkowskich, Komisja zwraca się w pierwszej kolejności do Rady.

Kolejnym istotnym elementem jej postawy wobec parlamentów krajowych jest poszanowanie konstytucyjnej różnorodności państw członkowskich. Czy jednym z konkretnych celów nie jest dołożenie starań, by żadnej z praktyk czy też procedur europejskich nie postrzegano jako pomijającej parlamenty krajowe? Komisja, jako strażnik unijnych traktatów, nie może pozostać obojętna w zakresie poszanowania fundamentalnych zasad każdego z państw członkowskich.

Niniejsze sprawozdanie z działalności jest spojrzeniem wstecz na osiągnięcie pragmatycznych i skromnych celów; powinno także pozwolić na doprecyzowanie zamierzeń, dostosowanie mapy drogowej, a nawet na określenie nowych celów na rok 2006, skoncentrowanych wokół dwóch osi: jedną stanowi konieczna kontynuacja dialogu w okresie refleksji, a drugą utworzenie wewnętrznego mechanizmu dalszych działań w dziedzinie pomocniczości.

2. Cele wyznaczone na rok 2005

W dniu 9 lutego 2005 r. M. Wallström przedstawiła kolegium listę dziesięciu celów w dziedzinie stosunków z parlamentami krajowymi (PK) wyznaczonych na nadchodzący rok.

1. Wizyty w parlamentach krajowych, uczestnictwo w konferencji przewodniczących parlamentów UE oraz w pracach konferencji komisji wyspecjalizowanych w sprawach wspólnotowych parlamentów UE (COSAC),

2. Sporządzenie rocznego sprawozdania,

3. Gotowość komisarzy i urzędników Komisji do służenia pomocą w związku z prośbami składanymi przez komisje PK w trakcie prowadzonych przez nie postępowań,

4. Szczegółowe ustalenie potrzeb PK w dziedzinie informacji, służące współpracy, aby uniknąć posądzenia Komisji o dążenie do pomijania PK i obywateli,

5. Wydanie biuletynu,

6. Utrzymywanie przez gabinet wiceprzewodniczącej Komisji wraz ze służbami Komisji ścisłych kontaktów z grupą urzędników łącznikowych (liaison officers) wyznaczonych przez PK,

7. Rola Komisji jako czynnika ułatwiającego komunikację w ramach IPEX[2] (elektronicznej sieci wymiany informacji o UE pomiędzy parlamentami krajowymi),

8. Rola Komisji jako czynnika ułatwiającego działania przewidziane w wytycznych w zakresie współpracy międzyparlamentarnej w Unii Europejskiej, przyjętych na konferencji przewodniczących parlamentów UE w Hadze w lipcu 2004 r.

9. Spotkania informacyjne przedstawicieli PK na temat określonych zagadnień,

10. Wyznaczenie przez Sekretariat Generalny Komisji służby lub osoby odpowiedzialnej za kontakty i koordynację wniosków pochodzących bezpośrednio od administracji parlamentów krajowych.

3. Realizacja celów

3.1. Wizyty w parlamentach krajowych

Margot Wallström podjęła się złożenia wizyty w każdym z parlamentów krajowych w trakcie obecnej kadencji parlamentarnej: w 2005 r. złożyła wizyty w parlamentach duńskim i szwedzkim, w hiszpańskim kongresie, w parlamencie irlandzkim, niderlandzkim, łotewskim (Saeima), oraz w parlamentach niemieckim i belgijskim.

Ponadto, komisarz Margot Wallström uczestniczyła w spotkaniach przewodniczących delegacji komisji parlamentarnych COSAC w Luksemburgu 9 lutego 2005 r. oraz w Londynie 18 lipca 2005 r. (zobacz również pkt 4 – doświadczenie pilotażowe).

Wreszcie, w dniu 6 maja 2005 r. uczestniczyła w konferencji przewodniczących parlamentów UE w Budapeszcie.

Należy również zwrócić uwagę na fakt, iż komisarze złożyli w roku 2005 ponad sześćdziesiąt wizyt w parlamentach krajowych.

3.2. Opracowanie rocznego sprawozdania

Cel ten spełnia niniejsze sprawozdanie.

3.3. Gotowość komisarzy i urzędników Komisji służenia pomocą w zakresie zapytań składanych przez komisje parlamentów krajowych

Komisarze udzielili pozytywnych odpowiedzi na zadawane przez zgromadzenia narodowe zapytania, w szczególności pochodzące od komisji parlamentarnych; w związku z tym odnotowano blisko 100 przypadków kontaktów lub bezpośrednich wizyt w parlamentach krajowych.

Urzędnicy Komisji uczestniczyli, na zaproszenie ze strony PK, w różnego rodzaju spotkaniach: w obradach komisji parlamentarnych PK (9 razy), w spotkaniach ze stałymi przedstawicielami PK (14 razy) i raz w obradach konferencji COSAC.

Ponadto w dniu 9 grudnia 2004 r. Kolegium wezwało każdą z dyrekcji generalnych Komisji do wyznaczenia urzędnika, którego zadaniem byłoby śledzenie spraw związanych z PK, oraz otwarte udzielanie odpowiedzi na zapytania składane przez PK.

3.4. 3.4. Szczegółowe ustalenie wymagań PK w ramach wykonywania ich uprawnień instytucjonalnych

Przez cały rok utrzymywano kontakty, tak ze stałymi przedstawicielami PK, jak i z urzędnikami łącznikowymi. Podkreślenia wymagają dwie istotne kwestie.

Znaczenie udostępniania dokumentów Komisji w odpowiednim czasie i we wszystkich wersjach językowych parlamentom krajowym, w szczególności dokonującym uprzedniej weryfikacji parlamentarnej. Dotyczy to, w ogólnym ujęciu, wszystkich dokumentów Komisji, lecz ma to szczególne znaczenie w odniesieniu do dokumentów programowania: rocznej strategii politycznej oraz programu legislacyjnego i programu prac. Zważywszy na ciążące na służbach tłumaczeniowych ograniczenia, Komisja odpowiedziała na te kwestie w sposób jedynie w części zadowalający. Należy rozważyć fakt, iż wprowadzenie w życie załączonych do Konstytucji protokołów dotyczących PK oraz pomocniczości byłoby wobec powyższego szczególnie utrudnione.

Ponadto, w odniesieniu do programowania prac Komisji, urzędnicy łącznikowi przedstawili prośbę: chcieliby mieć systematyczny dostęp do porządków obrad Komisji (kalendarza obrad i punktów wprowadzanych do porządku obrad). Na tą prośbę odpowiedziano również tylko w sposób pragmatyczny.

3.5. Wydawanie biuletynu

Dotychczas wydano i rozdystrybuowano wewnętrznie oraz w PE i PK trzy biuletyny (w dniach 28 lutego, 12 maja i 4 października 2005 r., zob. Załączniki).

3.6. Urzędnicy łącznikowi

W dniu 18 kwietnia Margot Wallström uczestniczyła w dorocznym spotkaniu urzędników łącznikowych narodowych parlamentów krajowych oraz Parlamentu Europejskiego w Brukseli.

Wszystkie zgromadzenia narodowe zostały powiadomione pismem z 24 maja 2005 r., że Philippe GODTS (z Sekretariatu Generalnego Komisji) został mianowany urzędnikiem łącznikowym ds. stosunków z parlamentami krajowymi.

3.7. IPEX

Wiceprzewodnicząca Margot Wallström w imieniu Komisji udzieliła przychylnej odpowiedzi na prośbę o podjęcie współpracy w ramach IPEX wyrażoną przez Andersa Forsberga, sekretarza generalnego RIKSDAGU.

Grupa ds. stosunków międzyinstytucjonalnych Komisji rozpatrzyła wcześniej ten wniosek i stwierdziła, że do rozważenia pozostaje ewentualny przyszły czynny udział służb Komisji w pracach technicznych IPEX, w zamierzeniu służący skutecznemu przekazywaniu drogą elektroniczną dokumentów wymienionych w protokole załączonym do Konstytucji.

Służby Komisji wzięły udział w czterech technicznych posiedzeniach IPEX, udzielając swego wsparcia próbnym wysyłkom dokumentów.

3.8. Konferencja przewodniczących parlamentów państw Unii Europejskiej

Wiceprzewodnicząca Margot Wallström uczestniczyła w konferencji przewodniczących parlamentów UE w dniu 6 maja 2005 r.

W odniesieniu do realizacji działań przewidzianych w Wytycznych w zakresie współpracy międzyparlamentarnej, określonych w Hadze w lipcu 2004 r. – zobacz w szczególności punkty odnoszące się do COSAC i IPEX.

3.9. Stali przedstawiciele

Komisja uczestniczyła w 14 spotkaniach stałych przedstawicieli parlamentów krajowych w Brukseli (patrz Załączniki). Warto odnotować również uczestnictwo Komisji w trzech spotkaniach zorganizowanych w 2004 r.

3.10. Osoba odpowiedzialna za kontakty

Jak już wyżej wspomniano, Philippe Godts został wyznaczony na urzędnika łącznikowego ds. stosunków z parlamentami krajowymi.

4. Projekt pilotażowy w zakresie pomocniczości

W Hadze, 23 listopada 2004 r. konferencja COSAC postanowiła o podjęciu pilotażowej próby zweryfikowania pomocniczości przewidzianego w załączonym do Konstytucji protokole na temat pomocniczości. Zamiarem COSAC było przeprowadzenie tej próby w odniesieniu do „trzeciego pakietu kolejowego”. Procedury tego doświadczenia zostały określone 9 lutego 2005 r. w Luksemburgu.

W obawie przed uprzedzeniem Konstytucji, Komisja powstrzymała się od przekazania swych propozycji bezpośrednio parlamentom krajowym. Wyraziła jedynie chęć dobrej współpracy poprzez udostępnienie omawianych tekstów sekretariatowi COSAC.

5. Udział w spotkaniach zorganizowanych przez Parlament Europejski

Komisja skorzystała z licznych zaproszeń do udziału w spotkaniach z przedstawicielami parlamentów państw członkowskich zorganizowanych przez Parlament Europejski – zarówno na poziomie komisji parlamentarnych, jak i doraźnie zaaranżowanych.

Wymienić należy m.in. uczestnictwo:

- Przewodniczącego J.M. Barrosa i wiceprzewodniczącego G. Verheugena w spotkaniu poświęconemu strategii lizbońskiej w dniach 16-17 marca 2005 r.

- Komisarz D. Grybauskaitė w zebraniu dotyczącym przyszłych wieloletnich ram finansowych UE w dniach 4-5 kwietnia 2005 r.

- Komisarza J. Almunii w zebraniu na temat nowych ogólnych kierunków polityk gospodarczych UE w dniu 25 kwietnia 2005 r.

Wypada również odnotować regularnie spotkania Komisji Wolności Obywatelskich, Sprawiedliwości i Spraw Wewnętrznych PE z PK z udziałem wiceprzewodniczącego F. Frattiniego.

6. Cele NA ROK 2006

Na rok 2006 utrzymane zostaną cele ogólne i zadania szczegółowe ustanowione w lutym 2005 r., podczas gdy te, które nie doczekały się pełnej realizacji będą w dalszym ciągu pogłębiane i dopracowywane (wizyty, określanie wymaganych typów informacji i sposobów współpracy, wymiana danych drogą elektroniczną, systematyczne uczestnictwo polityczne w posiedzeniach COSAC), z uwzględnieniem szczególnych obowiązków Komisji w okresie refleksji.

Zostanie zwrócona szczególna uwaga na dobrą współpracę międzyinstytucjonalną, odnotowaną już w 2005 r., w szczególności przy udziale Parlamentu Europejskiego pełniącego rolę najważniejszego rozmówcy Komisji.

Komisja zbada, przy ścisłej współpracy z Parlamentem Europejskim i parlamentami krajowymi, sposoby zapewnienia odpowiednich informacji na temat rocznej strategii politycznej, rocznego programu prac i rocznego programu legislacyjnego. Będzie również otwarta na wkład parlamentów krajowych w inicjatywy na etapie poprzedzającym złożenie wniosku prawodawczego w oparciu postanowienia obowiązujących traktatów

Komisja będzie kontynuować starania i poszerzać zakres koordynacji wewnętrznej w dziedzinie wzajemnych wizyt z parlamentami krajowymi oraz spotkań międzyparlamentarnych, a także uwidaczniania postępów w tej dziedzinie.

Komisja zbada możliwości aktywniejszego uczestniczenia w lokalnym dialogu z parlamentami krajowymi za pośrednictwem jej reprezentacji.

Some of them were particularly interested in the idea of an access to a Commission database with impact assessments linked to roadmaps, which could serve as an early warning system for parliamentary scrutiny. |

07.11.2005 | The permanent representatives were briefed by Mr FAROSS (DG TREN) on the Commission’s revised proposal on public transport services and state of play in the co-decision procedure of the file. They were interested in the situation and plans for further debate in the Council, relation with the third railway package and the importance of the Altmark case for the file. |

LIAISON OFFICERS

18.04.2005 | Annual Meeting of the Liaison Officers of the National Parliaments of the EU Member States and the European Parliament. Vice-President WALLSTRÖM presented the new Commission’s approach to the National Parliaments. (NPs). It focused on active networking and continuous and open dialogue. Vice-President WALLSTRÖM listed a series of goals/actions already kicked off by the Commission. She answered the questions concerning i.a. the subsidiarity check after the possible entry into force of the Constitutional Treaty and the scenarios in case of non-ratification. |
