    In Case C-117/05: reference for a preliminary ruling under Article 234 EC from the Unabhängiger Verwaltungssenat des Landes Oberösterreich (Austria), made by decision of 4 March 2005, received at the Court on 10 March 2005, in the proceedings between Manfred Seidl and Bezirkshauptmannschaft Grieskirchen — the Court (Fifth Chamber), composed of J. Makarczyk, President of the Chamber, R. Silva de Lapuerta (Rapporteur) and J. Klucka, Judges; A. Tizzano, Advocate General; R. Grass, Registrar, made an order on 2 December 2005, the operative part of which is as follows:

    Article 43 EC must be interpreted as precluding legislation of a Member State which prohibits the issue of a driving-school permit to a person who already holds a permit for the same purpose.
