Summary information on State aid granted pursuant to Commission Regulation (EC) No 1595/2004 of 8 September 2004 on the application of Articles 87 and 88 of the EC Treaty to State aid to small and medium-sized enterprises active in the production, processing and marketing of fisheries products

Summary information: Through Regional Council Decree No 889 of 30 June 2006, the Region of Campania approved funding to public-sector beneficiaries for fishing and aquaculture projects. The projects have been submitted and examined in accordance with the procedures set out in the Campania OP but will be financed from national resources transferred to Campania because the relevant measure in the Regional Programme (4.23) has been oversubscribed. The projects relate to:

Fisheries management in Campania, the development of innovative systems and an analysis of the economic and ecological sustainability of bottom trawling.

Bluefin Tuna — Mediterranean Quality

Pilot facility to optimise low cost production of algal biomass much used in open-air photobioreactors.

Commercial development of aquaculture products in Campania

Intensive rearing of copepods (zooplankton) to be used in place of Artemia as an alternative live feed for the larvae of fish species of commercial value.

Explanatory notes: These research and promotion measures are among those exempt from the notification requirement laid down in Article 3 of Regulation (EC) No 1595/2004, broken down as follows:

Annual expenditure planned under the scheme: EUR 422 988,98

Maximum intensity of the aid: 100 % of expenditure.

Date of implementation: Ten working days after the date the form in Annex I to Regulation (EC) No 1595/2004 is submitted to the Official Journal of the European Union for publication, as required by Article 16(1) of that Regulation.

Duration of the scheme: two years

Objective:

To implement research measures in the fisheries sector that contribute to the commercial development of resources and to the experimental development of systems for their management and to implement measures in the aquaculture sector that improve its competitiveness by influencing production processes and the diversification of production;

To implement promotional and commercial measures to improve information on and awareness of bluefin tuna.

Explanatory notes: The aid scheme provides for the grant of funding to modernise undertakings operating in the aquaculture sector.

Title of aid scheme or name of company receiving individual aid: Approval and publication in the Tuscany Region Official Bulletin of the call for the submission of funding applications in respect of the Aquaculture measure (Annex 3 to the 2006 programme mentioned in Regional Law No 66/2005 ‘Disciplina delle attività di pesca marittima e degli interventi a sostegno della pesca marittima e dell'acquicoltura’ (Regulation of sea-fishing effort and assistance for sea-fishing and aquaculture)

The call to which this summary note relates is part of the abovementioned 2006 Programme, which will shortly be approved by the Regional Council.

Legal basis: Legge Regionale n. 66/2005 ‘Disciplina delle attività di pesca marittima e degli interventi a sostegno della pesca marittima e dell'acquicoltura ’(Décision CE n. C(2005)1317 du 22.4.2005).

Annual expenditure planned: the programme of which the call covered by this note forms part provides for a total of EUR 2 500 080 in funding for 2006 in respect of this call and also of the call relating to aid for the fishing fleet. In their capacity as the bodies implementing the measures, the Provinces will allocate this funding between the two aid schemes. We shall notify the actual amount of funding allocated to aquaculture once the figure is known to us

The subsequent programmes for later years will establish the new financial items.

Maximum intensity of the aid: the aid scheme provides for a maximum contribution of 40 %, based on a total investment cost not exceeding EUR 250 000.

Date of application: funding applications can be submitted in the 45 days following the date of publication of the call in the Tuscany Region Official Bulletin.

Purpose of the aid: to encourage the modernisation of aquaculture facilities.

Specify the Article of Regulation (EC) No 1595/2004 used: Article 11.

Specify eligible costs: in compliance with Regulation (EC) No 2792/1999 and Regulation (EC) No 448/2004, eligible costs are those incurred on:

the purchase of equipment needed to modernise facilities (feeders, oxygenators, various kinds of machinery, water purification filters, etc.),

the building of breeding, fattening and decantation tanks,

the construction of working facilities on the undertaking (hatcheries, product processing and marketing, stores for machinery and equipment, etc.).

Annual expenditure planned under the scheme or overall amount of individual aid granted to the company: The annual expenditure planned under the RSA/SFI scheme in all sectors (not just fisheries and aquaculture) and all English regions, and Scotland and Wales is GBP 240 million (EUR 351 million)

The aid due to be granted to the beneficiary is GBP 33 000 over 1 year. The project involves the installation of a fish hatchery to produce 3 000 fish per week.

Maximum aid intensity: The maximum aid intensity will be 13,33 % on any single approved project. Aid is paid by way of cash grants and is paid against receipted invoices. No other form of aid is payable. The amount of aid intensity will not exceed, in subsidy equivalent (40 %) the total rate of national and Community subsidies fixed by Annex IV, of Regulation (EC) No 2792/1999 on any single approved project.

Date of implementation: Soon as exemption is approved 30 October 2006.

Duration of scheme or individual aid award: The SFI scheme is expected to last until 31 December 2006

Objective of aid: To improve the competitiveness of the eligible regions through support for good quality projects which provide sustainable new investment.

Aid will be made available under Articles 11(aquaculture) of Regulation (EC) No 1595/2004

Eligible project items for Grant aid must involve expenditure on fixed assets, such as property, plant and machinery. Assets can be purchased outright or by finance lease or hire-purchase terms. Some property leases may also be eligible. Certain costs of a non-recurring nature (patent rights, professional fees) may quality. Projects may be monitored for minimum of five years through to completion of the investment and beyond to ensure the conditions of the offer have been met.

Title of the aid scheme: Aid for fishery and aquaculture undertakings

Legal basis: legge regionale 14 aprile 2006, n. 3, ‘Disposizioni in materia di pesca ’art. 9 commi 2 e 6 e art.10.

Planned annual expenditure under the scheme: Total budget expenditure on the scheme provided for in Article 9 amounts to EUR 1 000 000 for 1996; the amounts to be spent in later years will be laid down in the Region's Budget Law.

Maximum intensity of the aid: the aid for measures referred to in Article 9 of the Regional Law, which are included among the possible aid projects provided for in Regulation (EC) No 2792/1999, as amended and completed, is established in accordance with Annex IV to that Regulation.

The maximum aid intensity in the case of aid provided for under Article 9(6) is as follows:

for the measures under (a) and (b) thereof: up to 100 % of eligible costs;

for the measures under (c) thereof: up to 60 % of eligible costs.

Date of implementation: The aid scheme will come into force ten working days after submission of this form, as provided for in Article 16(1) of the derogating Regulation (EC) No 1595/2004, but in any event after the date of entry into force of the Decree of the Assessore for the Protection of the Environment as referred to in point 5 of Article 9 of the Regional Law.

Duration of the scheme: 2006.

Purpose of the aid: As part of the measures designed to diversify fishing activities, the aid will enhance integrated activities characteristic of the sector's multi-functional nature, such as sport and recreational fishing, with a view to boosting ancillary activities by reducing the fishing effort while maintaining operators' income.

The Article used and eligible costs under the scheme: Article 12 of Regulation (EC) No 1595/2004.

Sector(s) concerned: Fishing and aquaculture in marine, brackish or fresh waters, including shellfish and mussel rearing.
