COMMISSION RECOMMENDATION No 4/96/ECSC of 21 November 1995 amending recommendation No 3118/94/ECSC and repealing recommendation No 73/95/ECSC

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Coal and Steel Community, and in particular Article 74 thereof,

Whereas pending the conclusion and entry into force of the agreements with Russia and Ukraine on trade in certain steel products covered by the European Coal and Steel Treaty, the requirement for an export licence for imports covered by those agreements was established by Commission recommendation No 73/95/ECSC (1);

Whereas with the entry into force of those agreements (2), together with the introduction of a requirement for a Community import licence in accordance with the rules set out in Commission Decision No 3/96/ECSC (3), it is necessary to repeal recommendation No 73/95/ECSC and, in order to avoid unnecessary duplication of procedures, to amend recommendation No 3118/94ECSC (4), as last amended by recommendation No 393/95/ECSC (5), so as to remove the requirement for surveillance documents in respect of the products originating in Russia and Ukraine which are covered by the agreements,

HEREBY RECOMMENDS:

Article 1

Recommendation No 73/95/ECSC is repealed.

Article 2

Article 1 (1) of recommendation No 3118/94/ECSC shall no longer apply in respect of the release for free circulation into the Community of those steel products covered by the ECSC Treaty originating in Russia and Ukraine which are the subject of the agreements between the European Coal and Steel Community and those countries and for which a Community import licence is required in accordance with the provisions of Decision No 3/96/ECSC.

Article 3

This recommendation shall enter into force on the day following that of its publication in the Official Journal of the European Communities.

This recommendation shall apply from 1 January 1996.
