Summary

Directive 86/653 on the coordination of the laws of the Member States relating to self-employed commercial agents must be interpreted as meaning that persons who act on behalf of a principal, but in their own name, do not come within the scope of that directive.

The activity pursued by persons acting on behalf of a third party but in their own name is different from that pursued by commercial agents and the interests and need for protection of the two occupations are not the same.
