    Draft Council Regulation creating a mechanism whereby the Commission can intervene in order to remove certain obstacles to trade (9348/98 - C4-0441/98 - 97/0330(CNS))

    The Council draft was approved with the following amendments:

    1a. Whereas, as provided for in Article 48 of the EC Treaty, freedom of movement for workers is one of the fundamental principles of the Community;

    Article 5(3)

    3. The Commission may publish in the Official Journal of the European Communities the text of the notification which it has sent to the Member State concerned and shall immediately transmit the text to any party which requests it.

    The Commission shall immediately place on its website the text of the notification which it has sent to the Member State concerned, shall publish it in the Official Journal of the European Communities and shall send it to any party which requests it.

    5. In exceptional cases and for clearly motivated reasons, and if the Member State so requests, the Commission may allow it an extension of the deadline mentioned in the previous paragraph.

    5.

    In exceptional cases, the Commission may allow an extension of the deadline mentioned in the previous paragraph if the Member State submits a duly substantiated request and the grounds cited are deemed acceptable.

    The European Parliament,

    - having regard to the Commission proposal to the Council, COM(97)0619 - 97/0330(CNS) ((OJ C 10, 15.1.1998, p. 14.)),

    - having regard to the draft text by the Council (9348/98 - 97/0330(CNS)),

    - having been consulted by the Council pursuant to Article 235 of the EC Treaty on the proposal by the Commission (C4-00011/98) and on the modified text by the Council (C4-0441/98),

    - having regard to Rule 58 of its Rules of Procedure,

    - having regard to the report of the Committee on Economic and Monetary Affairs and Industrial Policy and the opinions of the Committee on Legal Affairs and Citizens' Rights, the Committee on Employment and Social Affairs and the Committee on Civil Liberties and Internal Affairs (A4-0385/98),

    1. Approves the draft text by the Council, subject to Parliament's amendments;

    2. Calls on the Council to notify Parliament should it intend to depart from the text approved by Parliament;

    3. Calls for the conciliation procedure to be opened should the Council intend to depart from the text approved by Parliament;4. Instructs its President to forward this opinion to the Council and Commission.
