Summary

There is no need to give a decision on an action for annulment brought by an undertaking against a Commission decision authorizing national aid to a competitor, where the applicant' s interest in bringing the proceedings, if there were any, no longer subsists owing to the fact that it has in the meantime, but before payment of the aid could affect its competitive situation, been declared bankrupt.
