EXPLANATORY MEMORANDUM

Following the outcome of the elections that took place recently, the Federal Republic of Yugoslavia is in a new political situation marked by a clear will to change. When the political circumstances are right, it may be necessary, in order to help consolidate democracy and rule of law, to lift the flight ban in respect of the Federal Republic of Yugoslavia.

The present proposal for an (EC) Regulation is intended to implement that objective in the legal order of the Community.

COUNCIL REGULATION

repealing Regulation (EC) No 2151/1999 imposing a ban on flights between the territories of the Community and the Federal Republic of Yugoslavia other than the Republic of Montenegro or the Province of Kosovo

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community, and in particular Article 301 thereof,

Having regard to Common Position XXXXXX [1] of XX October 2000 defined by the Council on the basis of Article 15 of the Treaty on European Union, concerning flights between the territory of the Community and the territories of the Federal Republic of Yugoslavia concerned (Serbia),

Having regard to the proposal from the Commission [2],

Whereas:

(1) Following the outcome of the elections that took place recently, the Federal Republic of Yugoslavia is in a new political situation marked by a clear will to change, and, in these circumstances a lifting of the ban on flights between the European Community and the Federal Republic of Yugoslavia may contribute to the consolidation of democracy and the rule of law.

HAS ADOPTED THIS REGULATION:

Article 1

Regulations (EC) No 2151/1999 [3] and No 607/2000 [4] shall be repealed.

Article 2

This Regulation shall enter into force on the day of its publication in the Official Journal of the European Communities.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
