PROCES-VERBAL OF RECTIFICATION OF THE TREATY ESTABLISHING THE EUROPEAN ATOMIC ENERGY COMMUNITY SIGNED IN ROME ON 25 MARCH 1957

Whereas certain clerical errors have come to light in the original text of the Treaty establishing the European Atomic Energy Community signed in Rome on 25 March 1957 and of which the Government of the Italian Republic is the depositary;

Whereas these errors were brought to the notice of the States which were signatories to the Treaty by letter of 25 June 1999 from the Legal Adviser to the Council of the European Union to the Permanent Representatives of the Member States; whereas the Member States have not raised any objections to the corrections proposed in that letter before the expiry of the time limit indicated therein;

The said errors have this day been rectified in the Ministry for Foreign affairs of the Italian Republic along the lines indicated in the Annex.

In witness whereof this Procès-Verbal has been drawn up, a copy of which will be addressed to the Governments of the Signatory States to the said Treaty.

Done at Rome, on the twenty-sixth day of July in the year one thousand nine hundred and ninety-nine.

ANNEX

Article 156 of the EAEC Treaty

for: "Notwithstanding the expiry of the period laid down in the third paragraph of Article 146, ... plead the grounds specified in the first paragraph of Article 146, in order ...",

read: "Notwithstanding the expiry of the period laid down in the fifth paragraph of Article 146, ... plead the grounds specified in the second paragraph of Article 146, in order ...".

Article 177(5), first subparagraph, point (b), third indent of the EAEC Treaty

for: "- where, in pursuance of the two preceding subparagraphs, ..."

read: "- where, in pursuance of one of the two preceding indents ..."
