Nella causa C-482/03, avente ad oggetto un ricorso per inadempimento ai sensi dell'art. 226 CE, proposto il 19 novembre 2003, Commissione delle Comunità europee (agente: sig. W. Wils) contro Irlanda (agente: sig. D. O'Hagan, assistito dal sig. D. Moloney, BL), la Corte (Sesta Sezione), composta dai sigg. J.-P. L'Irlanda, non avendo adottato le disposizioni legislative, regolamentari e amministrative necessarie per trasporre la direttiva del Parlamento europeo e del Consiglio 26 febbraio 2001, 2001/14/CE, relativa alla ripartizione della capacità di infrastruttura ferroviaria, all'imposizione dei diritti per l'utilizzo dell'infrastruttura ferroviaria e alla certificazione di sicurezza, è venuta meno agli obblighi ad essa incombenti ai sensi di tale direttiva. |

L'Irlanda è condannata alle spese. |
