A BIZOTTSÁG (EU) 2020/1715 VÉGREHAJTÁSI HATÁROZATA

(2020. november 16.)

a Hollandiában előforduló, a H5N8 altípusba tartozó, magas patogenitású madárinfluenzával kapcsolatos egyes védintézkedésekről szóló (EU) 2020/1606 végrehajtási határozat mellékletének módosításáról

AZ EURÓPAI BIZOTTSÁG,

tekintettel az Európai Unió működéséről szóló szerződésre,

tekintettel a belső piac megvalósításának céljával a Közösségen belüli kereskedelemben alkalmazható állategészségügyi ellenőrzésekről szóló, 1989. december 11-i 89/662/EGK tanácsi irányelvre (1) és különösen annak 9. cikke (3) bekezdésére,

tekintettel az egyes élőállatok és állati termékek Unión belüli kereskedelmében a belső piac megvalósításának céljával alkalmazandó állategészségügyi ellenőrzésekről szóló, 1990. június 26-i 90/425/EGK tanácsi irányelvre (2) és különösen annak 10. cikke (3) bekezdésére,

mivel:

Az (EU) 2020/1606 bizottsági végrehajtási határozat (3) elfogadására azt követően került sor, hogy egy Gelderland tartománybeli (Hollandia) baromfitartó gazdaságban a H5N8 altípusba tartozó, magas patogenitású madárinfluenza kitörését észlelték, és a szóban forgó tagállam illetékes hatósága a 2005/94/EK tanácsi irányelvben (4) előírtaknak megfelelően védő- és megfigyelési körzeteket hozott létre.

Az (EU) 2020/1606 végrehajtási határozat úgy rendelkezik, hogy a Hollandia által a 2005/94/EK irányelvnek megfelelően kialakított védő- és megfigyelési körzeteknek legalább a szóban forgó végrehajtási határozat mellékletében védő- és megfigyelési körzetekként felsorolt területeket magukban kell foglalniuk.

Az (EU) 2020/1606 végrehajtási határozat mellékletét a közelmúltban az (EU) 2020/1670 bizottsági végrehajtási határozat (5) módosította azt követően, hogy a hollandiai Gelderland tartományban a H5N8 altípusba tartozó, magas patogenitású madárinfluenza újabb előfordulását észlelték, amit az említett mellékletnek tükröznie kell.

Az (EU) 2020/1670 végrehajtási határozat elfogadása óta Hollandia értesítette a Bizottságot a H5N8 altípusba tartozó, magas patogenitású madárinfluenzának egy Groningen tartománybeli baromfitartó gazdaságban észlelt kitöréséről, és meghozta a 2005/94/EK irányelvben előírt szükséges intézkedéseket, beleértve az ezen új kitörés körüli védő- és megfigyelési körzetek létrehozását.

A Bizottság Hollandiával együttműködve megvizsgálta az intézkedéseket, és meggyőződött arról, hogy a tagállam illetékes hatósága által létrehozott védő- és megfigyelési körzetek határai elegendő távolságra vannak azoktól a gazdaságoktól, amelyekben megerősítésre került a H5N8 altípusba tartozó, magas patogenitású madárinfluenza kitörése.

Az Unión belüli kereskedelem szükségtelen megzavarásának megelőzése, valamint a harmadik országok által felállított indokolatlan kereskedelmi akadályok elkerülése érdekében Hollandiával együttműködve mihamarabb meg kell határozni uniós szinten a szóban forgó tagállamban – a 2005/94/EK irányelvnek megfelelően – újonnan létrehozott védő- és megfigyelési körzeteket. Ezért az (EU) 2020/1606 végrehajtási határozat mellékletében Hollandia tekintetében felsorolt védő- és megfigyelési körzeteket módosítani kell.

Ennek megfelelően a Növények, Állatok, Élelmiszerek és Takarmányok Állandó Bizottságának következő üléséig az uniós szintű regionalizáció aktualizálása érdekében módosítani kell az (EU) 2020/1606 végrehajtási határozat mellékletét a Hollandia által a 2005/94/EK irányelvnek megfelelően létrehozott új védő- és megfigyelési körzetek és az azokban alkalmazandó korlátozások időtartamának figyelembevétele céljából.

(8)	Az (EU) 2020/1606 végrehajtási határozatot ezért ennek megfelelően módosítani kell.

(9)	Tekintettel a H5N8 altípusba tartozó, magas patogenitású madárinfluenza terjedésével kapcsolatos uniós járványügyi helyzet sürgősségére, fontos, hogy az (EU) 2020/1606 végrehajtási határozat mellékletének az e határozattal való módosítása a lehető leghamarabb hatályba lépjen.

(10)	Ezt a határozatot a Növények, Állatok, Élelmiszerek és Takarmányok Állandó Bizottságának következő ülésén felül kell vizsgálni,

ELFOGADTA EZT A HATÁROZATOT:

1. cikk

Az (EU) 2020/1606 végrehajtási határozat mellékletének helyébe e határozat mellékletének szövege lép.

2. cikk

Ennek a határozatnak a Holland Királyság a címzettje.
