    An action against the Italian Republic was brought before the Court of Justice of the European Communities on 29 July 2005 by Commission of the European Communities, represented by M. van Beek and D. Recchia, of its Legal Service.

    The applicant claims that the Court should:

    1.

    Declare that, in relation to the project for the extension and improvement of the Santa Caterina Valfurva ski area (the ‘Bucaneve’ and ‘Edelweiss’ pistes) and for provision of the corresponding ski facilities, with a view to the holding of the 2005 world Alpine ski championships in SPA IT 2040044 Parco Nazionale dello Stelvio, by having:

    allowed measures to be taken which are liable to have a significant impact on SPA IT 2040044 Parco Nazionale dello Stelvio without making such measures subject to an appropriate assessment of the impact on the site in the light of the conservation objectives for it and, in any event, without complying with the provisions which allow a project to be carried out, in the event of the conclusions of the impact assessment being negative, only in the absence of alternative solutions and only after the adoption and communication to the commission of the compensatory measures necessary to ensure that the overall coherence of ‘Natura 2000’ is protected;

    failed to adopt measures to avoid deterioration of natural habitats and species habitats and the disturbance of species for which the SPA IT 2040044 Parco Nazionale dello Stelvio was designated;

    failed to endow SPA IT 2040044 Parco Nazionale dello Stelvio with the legally protected status capable of guaranteeing, in particular, the survival and breeding of the species of birds mentioned in Annex I to Directive 79/409/EEC, (1) and the breeding, moulting and wintering of the migratory species not covered by Annex I which visit that locality regularly;

    the Italian Republic has failed to fulfil its obligations under the combined provisions of Articles 6(2) to (4) and 7 of Directive 92/43/EEC (2) and of Article 4(1) and (2) of Directive 79/409/EEC;

    2.

    Order Italian Republic to pay the costs.
