Action brought on 21 September 2004 by the Commission of the European Communities against the Kingdom of the Netherlands

An action against the Kingdom of the Netherlands was brought before the Court of Justice of the European Communities on 21 September 2004 by the Commission of the European Communities, represented by Knut Simonsson and Wouter Wils.

The applicant claims that the Court should:

1.

Declare that, by not adopting the legislative and administrative measures necessary in order to implement Directive 2001/96/EC (1) of the European Parliament and the Council of 4 December 2001 establishing harmonised requirements and procedures for the safe loading and unloading of bulk carriers, or at any rate by not informing the Commission thereof, the Kingdom of the Netherlands has failed to fulfil its obligations under that directive.

2.

Order the Kingdom of the Netherlands to pay the costs.

Pleas and main arguments:

The period allowed for transposition of Directive 2001/96/EC expired on 5 August 2003.
