Declare that, by failing to adopt the laws, regulations and administrative provisions necessary fully to implement Commission Directive 2008/74/EC of 18 July 2008 amending, as regards the type approval of motor vehicles with respect to emissions from light passenger and commercial vehicles (Euro 5 and Euro 6) and access to vehicle repair and maintenance information, Directive 2005/55/EC of the European Parliament and of the Council and Directive 2005/78/EC, (1) or by failing to notify the Commission thereof, the Republic of Austria has failed to fulfil its obligations under that directive;

order the Republic of Austria to pay the costs.

Pleas in law and main arguments

The time-limit for transposition of Directive 2008/74 expired on 2 January 2009.
