Council Regulation (EC) No 428/2009 of 5 May 2009 setting up a Community regime for the control of exports, transfer, brokering and transit of dual-use items — Information on measures adopted by Member States in conformity with Articles 5 and 8

Articles 5 and 8 of Council Regulation (EC) No 428/2009 (1) foresee that Member States may impose authorisations requirements, respectively for brokering services and, in certain cases, for export of dual-use items not listed in Annex I to the Regulation. In accordance with Article 5(4) and Article 8(4) such measures shall be published in the Official Journal of the European Union.

The Netherlands has notified to the Commission that it has published Decree Stcrt. 2013 No 8590 on 28 March 2013 imposing the following measures:

an authorisation requirement for the brokering of certain dual-use items not listed in Annex I, where the items are or may be intended for uses mentioned in Article 4(1) of the Regulation,

an authorisation requirement for the export of certain dual-use items not listed in Annex I for reasons of public security and human rights considerations.

The measures apply to the brokering and export, with destination Syria, of the following 31 chemical substances and a specific type of laboratory equipment:
