COMMISSION REGULATION (EC) No 480/97 of 14 March 1997 amending Annex I to Council Regulation (EEC) No 2658/87 on the tariff and statistical nomenclature and on the Common Customs Tariff THE COMMISSION OF THE EUROPEAN COMMUNITIES, Having regard to the Treaty establishing the European Community, Having regard to Council Regulation (EEC) No 2658/87 of 23 July 1987 on the tariff and statistical nomenclature and on the Common Customs Tariff (1), as last amended by Commission Regulation (EC) No 288/97 (2), and in particular Articles 9 and 12 thereof, Whereas, in the Uruguay Round talks, specified pharmaceutical products were to a certain extent granted exemption from customs duties; whereas the first review of the agreements relating to such products has now taken place within the WTO; Whereas, accordingly, Council Regulation (EC) No 467/97 (3) provides for duty-free treatment for certain active ingredients bearing an 'international non-proprietary name` (INN) from the World Health Organization and for certain products used for the manufacture of finished pharmaceuticals; whereas it also provides for the withdrawal of duty-free treatment as pharmaceutical products from certain INN products whose use is predominantly non-pharmaceutical; Whereas these amendments should be incorporated into Annex I to Council Regulation (EEC) No 2658/87; Whereas the measures provided for in this Regulation are in accordance with the opinion of the Tariff and Statistical Nomenclature Section of the Customs Code Committee, HAS ADOPTED THIS REGULATION: Article 1 Annex I, Part Two, to Council Regulation (EEC) No 2658/87 is hereby amended in accordance with Annex I to this Regulation. Article 2 Annex I, Part Three, Section II, to Council Regulation (EEC) No 2658/87 is hereby amended as follows: 1. the products included in Annex II to this Regulation shall be added to Annex 3; 2. the products included in Annex III to this Regulation shall be deleted from Annex 3; 3. the products included in Annex IV to this Regulation shall be added to Annex 4; 4. the products included in Annex V to this Regulation shall be added to Annex 6. Article 3 This Regulation shall enter into force on the third day following its publication in the Official Journal of the European Communities. It shall apply from 1 April 1997. This Regulation shall be binding in its entirety and directly applicable in all Member States. Done at Brussels, 14 March 1997.
