The Court is asked to:

declare that, by failing to adopt the laws, regulations and administrative provisions necessary to comply with Directive 2004/12/EC (1) of the European Parliament and of the Council of 11 February 2004 amending Directive 94/62/EC on packaging and packaging waste, and in any event by failing to inform the Commission thereof, the Hellenic Republic has infringed its obligations under that directive;

order the Hellenic Republic to pay the costs.

Pleas in law and main arguments

The time-limit for transposing Directive 2004/12/EC into national law expired on 18.8.2005.
