    Proposal for a Council Regulation amending Regulation (EEC) No 1442/88 on the granting, for the 1988/89 to 1997/98 wine years, of permanent abandonment premiums in respect of wine-growing areas (COM(96)0706 - C4-0047/97 - 97/0009(CNS))

    The proposal was approved with the following amendments:

    (Amendment 1)

    ARTICLE 1(-1) (new)

    Article 1(1) (Regulation (EEC) No 1442/88)

    -1. The following is added to Article 1(1), second subparagraph (a) of Regulation (EEC) No 1442/88:

    'Areas in respect of which no application was made for a permanent abandonment premium for the 1996/97 wine year may be added to the areas assigned to each Member State for the 1997/98 wine year.'

    (Amendment 2)

    ARTICLE 1(2)

    Article 4(1), 1st subparagraph a (new) (Regulation (EEC) No 1442/88)

    However, for the 1996/97 wine year, the time limit of 31 December 1996 fixed for eligible producers to present applications for the grant of the premium to the authorities designated by Member States shall be postponed until 31 January 1997.

    However, for the 1996/97 wine year, the time limit of 31 December 1996 fixed for eligible producers to present applications for the grant of the premium to the authorities designated by Member States shall be postponed until 31 March 1997.

    (Amendment 3)

    ARTICLE 1(2a) (new)

    Article 4(2) (Regulation (EEC) No 1442/88)

    2a. Article 4(2) is replaced by the following:

    '2. The grant of the premium shall be subject to a written declaration in which the applicant undertakes to grub up the vines on the areas in respect of which the premium has been applied for or to have them grubbed up before 31 May of the year following that in which the application is submitted.'

    (Consultation procedure)

    The European Parliament,

    - having regard to the Commission proposal to the Council, COM(96)0706 - 97/0009(CNS),

    - having been consulted by the Council pursuant to Article 43 of the EC Treaty (C4-0047/97),

    - having regard to Rule 58 of its Rules of Procedure,

    - having regard to the report of the Committee on Agriculture and Rural Development and the opinion of the Committee on Budgets (A4-0077/97),

    1. Approves the Commission proposal, subject to Parliament's amendments;

    2. Calls on the Council to notify Parliament should it intend to depart from the text approved by Parliament;

    3. Asks to be consulted again should the Council intend to make substantial modifications to the Commission proposal;

    4. Instructs its President to forward this opinion to the Council and Commission.
