    DECISION OF THE EEA JOINT COMMITTEE

    No 44/2010

    of 30 April 2010

    amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

    THE EEA JOINT COMMITTEE,

    Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

    Whereas:

    (1)

    Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 97/2008 of 26 September 2008 (1).

    (2)

    Directive 2009/64/EC of the European Parliament and of the Council of 13 July 2009 on the suppression of radio interference produced by agricultural or forestry tractors (electromagnetic compatibility) (2) is to be incorporated into the Agreement.

    (3)

    Directive 2009/64/EC repeals Council Directive 75/322/EEC (3) which is incorporated into the Agreement and is therefore to be repealed under the Agreement,

    HAS DECIDED AS FOLLOWS:

    Article 1

    Chapter II of Annex II to the Agreement shall be amended as follows:

    1.

    the text of point 7 (Council Directive 75/322/EEC) shall be deleted;

    2.

    the following shall be inserted after point 30 (Directive 2008/2/EC of the European Parliament and of the Council):

    ‘31.

    32009 L 0064: Directive 2009/64/EC of the European Parliament and of the Council of 13 July 2009 on the suppression of radio interference produced by agricultural or forestry tractors (electromagnetic compatibility) (OJ L 216, 20.8.2009, p. 1).

    The provisions of the Directive shall, for the purposes of this Agreement, be read with the following adaptation:

    in the second paragraph of point 5.2 of Annex I, the following shall be added:

    “IS for Iceland; FL for Liechtenstein; 16 for Norway.” ’

    Article 2

    The text of Directive 2009/64/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

    Article 3

    This Decision shall enter into force on 1 May 2010, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

    Article 4

    This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
