Aid intensity or amount: For the cost of collecting and transporting fallen stock as from 1 January 2005, the amount of compensation cannot exceed EUR 300 per head of cattle and buffalo and EUR 65 per head of sheep and goats. Even where the aid is combined with other aid received in the same capacity and for the same stock, compensation cannot exceed 100 % of the costs actually incurred by the farmer.

For the cost of destroying the carcases of fallen stock found as from 1 January 2005, the amount of compensation cannot exceed EUR 50 per head of cattle and buffalo and EUR 7 per head of sheep and goats. Even where the aid is combined with other aid received in the same capacity and for the same stock, compensation cannot exceed 75 % of the costs actually incurred by the farmer

Explanatory notes adopted in accordance with the procedure defined in Article 10(1) of Council Regulation (EEC) No 2658/87 of 23 July 1987 on the tariff and statistical nomenclature and on the Common Customs Tariff (1)

The explanatory notes to the Combined Nomenclature of the European Communities' (2) shall be amended as follows:

On page 357:

8712 00

Bicycles and other cycles (including delivery tricycles), not motorised

Insert the following text:

‘This heading includes incomplete bicycles that have the essential characteristics of complete bicycles (General rule 2(a) for the interpretation of the Combined Nomenclature).

An incomplete bicycle, whether or not assembled, is to be classified under heading 8712 if it consists of the frame, the fork and at least two of the following components:

a set of wheels;

crank-gear (including axle, crank);

steering unit (including handlebar and handlebar stems);

a brake system.’

Prior notification of a concentration

1.

On 28 March 2006, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertakings Deutsche Bank AG London belonging to the Deutsche Bank group (‘DB’, Germany) and Lone Star Fund V (U.S) L.P. and Lone Star Fund V (Bermuda) L.P. ( collectively referred to as ‘Lone Star’) acquire within the meaning of Article 3(1)(b) of the Council Regulation joint control of the undertaking Vivanco Gruppe AG (‘VG’, Germany) by way of purchase of shares.

2.

The business activities of the undertakings concerned are:

for DB: universal banking services;

for Lone Star: private equity investments;

for VG: manufacturing and distribution of technical accessories for consumer electronics, telecommunications, IT and mobile products.

3.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

4.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.

Observations must reach the Commission not later than 10 days following the date of this publication. On 29 March 2006 the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertakings Deutsche Bank AG (‘DB’, Germany), Goldman Sachs Group, Inc. (‘GS’, United Kingdom) and Lone Star Fund V (‘LS’, USA and Bermuda) acquire within the meaning of Article 3(1)(b) of the Council Regulation joint control of the undertaking Deutsche Steinzeug Cremer & Breuer AG (‘DSCB’, Germany) by way of purchase of shares following a debt restructuring plan.

2.

The business activities of the undertakings concerned are:

for DB: universal banking services;

for GS: investment banking and securities;

for LS: private equity investments;

for DSCB: manufacturer and distributor of ceramic tiles.

3.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

4.

On 31 March 2006, the Commission received a notification of a proposed concentration pursuant to Article 4 and following a referral pursuant to Article 4(5) of Council Regulation (EC) No 139/2004 (1) by which the undertaking Korsnäs AB (‘Korsnäs’, Sweden) controlled by Investment AB Kinnevik (‘Kinnevik’, Sweden) acquires within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of the undertaking AssiDomän Cartonboard Holding AB (‘AD Cartonboard’, Sweden) by way of purchase of shares.

2.

The business activities of the undertakings concerned are:

for Kinnevik: holding company with equity interest in telecoms and medias companies;

for Korsnäs: production and sale of paper board including liquid packaging board, sack paper and fluff pulp;

for AD Cartonboard: production and sale of consumer packaging board, including liquid packaging board.

3.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved.

4.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.
