Prior notification of a concentration

(Case M.7222 — Enercon Independent Power Producer/Gothaer Leben Renewables/Skogberget Vind)

On 13 June 2014, the European Commission received notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertakings Enercon Independent Power Producer GmbH (Germany), belonging to the German Enercon group and Gothaer Leben Renewables GmbH (Germany), belonging to the German Gothaer insurance group, acquire within the meaning of Article 3(1)(b) of the Merger Regulation joint control of the undertaking Skogberget Vind AB (‘Skogberget’, Sweden) by way of purchase of shares. Skogberget was already controlled by Enercon Independent Power Producer GmbH.

The business activities of the undertakings concerned are:

—   Enercon group: manufacture and supply of wind turbines,

—   Gothaer insurance group: provision of life, health and non-life insurance,

—   Skogberget: Generating electricity from wind turbines in northern Sweden and marketing it at the wholesale level.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of the Merger Regulation. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under the Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

The Commission invites interested third parties to submit to it their possible observations on the proposed operation.

Observations must reach the Commission not later than 10 days following the date on which this notification is published.
