    Prior notification of a concentration

    (Case COMP/M.5524 — Météo-France/CDC/NYSE Euronext/MetNext)

    1.

    On 30 April 2009, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004, (1) by which Caisse des Dépots et Consignations (‘CDC’, France, belonging to the French State), Météo-France (France, belonging to the French State) and NYSE Euronext (United States) would jointly acquire control of MetNext (France), within the meaning of Article 3(1)(b) of the Regulation, by purchase of shares.

    The business activities of the undertakings concerned are:

    CDC: is a publicly owned group operating in personal insurance (CNP Assurances), property (SNI and Icade), capital investment and services,

    Météo-France: gathers and provides French and European weather and climate information,

    NYSE Euronext: manages markets for financial instruments,

    MetNext: develops and markets products designed (i) to enable industrial leaders to manage and anticipate the impact of weather variations on their businesses, and (ii) to enable certain service providers (insurers in particular) to structure index-based weather cover for their customers.

    3.

    On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

    The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.
