In Case C-39/95,
REFERENCE to the Court under Article 177 of the EC Treaty by the Tribunal de Police, La Rochelle (France), for a preliminary ruling in the criminal proceedings before that court against Pierre Goupil, on the interpretation of Article 4(6) of Council Regulation (EEC) No 3820/85 of 20 December 1985 on the harmonization of certain social legislation relating to road transport (OJ 1985 L 370, p. 1),THE COURT (First Chamber),,
after considering the written observations submitted on behalf of:
having regard to the Report for the Hearing,
after hearing the oral observations of Mr Goupil, represented by Paul Mauriac and Alexandre Carnelutti, of the French Government, represented by Romain Nadal, Deputy Secretary for Foreign Affairs in the Legal Department of the Ministry of Foreign Affairs, acting as Agent, of the United Kingdom, represented by Nicholas Green, Barrister, and of the Commission, represented by Götz zur Hausen, at the hearing on 30 November 1995,
after hearing the Opinion of the Advocate General at the sitting on 25 January 1996,
gives the following
