Date of implementation: The scheme will start on 10th December 2010

Duration of scheme or individual aid award: The scheme will start on 10 December 2010. The last payment date will be the 31 December 2017 and the closure date of the scheme is 30 November 2017. The scheme has opened to record expressions of interest but no expenditure on any of the measures will take place until the Commission has agreed the scheme can proceed.

Objective of aid: The objective of the aid is to help cattle farmers minimise the impacts of Bovine Tuberculosis (TB) and reduce the risk of repeat breakdowns. We will do this by providing enhanced veterinary, bio-security and business advice to TB affected farmers (focusing on farmers with herds under TB restrictions for a lengthy period and those experiencing their first breakdown). Delivery will vary from one-to-one advice (for example, business advice, or private veterinary surgeon visit to breakdown herds to reduce risks of further disease outbreaks and control impacts), and on-farm bio-security demonstrations in partnership with industry, involving up to 15 farmers per event.

Provision of this technical support in the agricultural sector will be in line with Article 15 of Regulation (EC) No 1857/2006.

Annual expenditure planned under the scheme or overall amount of individual aid granted to the company: The cost of the Scheme is GBP 10 million per annum. This figure includes admin and the Department’s Veterinary Service staff costs as well as lab costs.

Maximum aid intensity: Aid to compensate farmers for the costs of prevention and eradication of brucellosis incurred for the costs of health checks, tests and other screening measures, slaughter and destruction costs of animals will not exceed 100 % of the eligible costs.

Compensation paid to farmers for the slaughter of affected animals in accordance will be limited to the following maximum aid intensities:

Brucellosis reactors: 75 % of the animal’s market value.

Other animals (brucellosis in-contacts): 100 % of market value for other animals slaughtered as a result of brucellosis.

All aid intensities are compliant with Article 10 Commission Regulation (EC) No 1857/2006 (OJ L 358, 16.12.2006, p. 8).

Date of implementation: From 14 December 2010 or the date upon which notification is made to the Commission (if later).

Duration of scheme or individual aid award: The Scheme will run for seven years from the date the Scheme is published on the Commission website.

Objective of aid: The aid is to compensate farmers for the costs of prevention and eradication of bovine brucellosis incurred for the costs of health checks, tests and other screening measures and the slaughter and destruction of animals including income losses due to quarantine obligations (Article 10.1 of Regulation (EC) No 1857/2006).

Brucellosis is a disease listed in Annex I to Council Decision 2009/470/EC which repealed and replaced Decision 90/424/EEC

Other information: Beneficiaries will be limited to small and medium-sized agricultural holdings (farms) within Northern Ireland active in the primary production of agricultural products (Article 1 of Regulation (EC) No 1857/2006).

Aid for screening tests and control measures will be by means of a subsidised service (Article 10.1 of Regulation (EC) No 1857/2006) and by means of compensation payments to farmers for slaughtered animals (Article 10.2 of Regulation (EC) No 1857/2006).

Over-Compensation: Over-Compensation — The maximum amount of loss eligible for aid will be reduced by (a) any amount received under insurance schemes; and (b) costs not incurred because of the disease, which would otherwise have been incurred (Article 10.3 Regulation (EC) No 1857/2006).

In addition, compensation arrangements rely on individual valuations carried out by a livestock evaluation officer from the Department and, in the case of a disagreement over the Department's valuation, on a second individual valuation carried out by an independent valuer. There is ultimate recourse, for both the herdkeeper and the Department, to a Valuation Appeals Panel appointed by the Department. A Senior Livestock Valuation Officer from the Department is responsible for ensuring that valuations are consistent across Northern Ireland and also to monitor current market values in order to ensure that valuations reflect market trends.

Objective of aid: Aid to combat animal diseases under Article 10 of Regulation (EC) No 1857/2006.

The costs of vaccine for the vaccination of cattle and sheep in Bavaria against bluetongue will be reimbursed under Article 10(1) of Regulation (EC) No 1857/2006 as a measure for the prevention and control of bluetongue. The purpose of the reimbursement is to encourage take-up of the vaccine among livestock keepers and achieve the most comprehensive vaccination coverage possible among Bavarian herds of cattle and flocks of sheep. This should give the livestock the best possible protection against bluetongue, which is classified as an animal disease in the OIE list and in the Annex to Decision 90/424/EEC.

Aid will be granted under Article 10(2) of Regulation (EC) No 1857/2006 to compensate Bavarian beef farmers in recognised BHV1-free areas (the Bavarian regions listed in Annex II to Decision 2004/558/EC) for part of the loss of income incurred as a result of quarantine obligations on the basis of the Commission Decision of 15 July 2004 implementing Council Directive 64/432/EEC as regards additional guarantees for intra-Community trade in bovine animals relating to infectious bovine rhinotracheitis and the approval of the eradication programmes presented by certain Member States (2004/558/EC). This should increase the effectiveness of the quarantine measures and ensure that the recognised BHV1-free areas remain free of the disease. BHV1 is an OIE-listed animal disease which causes serious damage to agriculture and against which Bavaria is engaged in an ongoing fight.

The beneficiaries are small and medium-sized enterprises within the meaning of Regulation (EC) No 1857/2006.

The aid does not concern measures for which Community law requires the costs to be borne by the agricultural holdings themselves.

Aid under Article 10(1) of Regulation (EC) No 1857/2006 will not be granted as direct payments to agricultural holdings but as subsidised services. The Bavarian Animal Diseases Fund will assume the costs of the services and pay the service providers. The gross aid intensity will not exceed 100 %. The services relate to the costs of purchasing bluetongue vaccine.

Aid under Article 10(2) of Regulation (EC) No 1857/2006 is intended to mitigate loss of income incurred as a result of quarantine obligations due to BHV1, an animal disease. Here too, the gross aid intensity will not exceed 100 %.

Objective of aid: Aid in respect of animal diseases under Article 10 of Regulation (EC) No 1857/2006, in connection with existing federal State, federal and EU disease control, monitoring and improvement strategies.

Aid is granted in particular:

in the form of grants towards costs incurred as a result of measures prescribed by the authorities aimed at preventing and controlling animal diseases and other epidemics or zoonoses,

in the form of grants towards costs incurred during state-promoted or voluntary control measures,

in the form of grants towards the costs of the work of Tierseuchenkasse animal health services, and
